Common use of Preferred Units Clause in Contracts

Preferred Units. If the Partnership gives a notice of redemption in respect of Series D-3 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 Preferred Units upon surrender of the Series D-3 Preferred Units by such holders at the place designated in the notice of redemption.

Preferred Units. If the Partnership gives a notice of redemption in respect of Series D-3 D-14 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-14 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-14 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-14 Preferred Units upon surrender of the Series D-3 D-14 Preferred Units by such holders at the place designated in the notice of redemption.

If the Partnership gives a notice of redemption in respect of Series D-3 D-7 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-7 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-7 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-7 Preferred Units upon surrender of the Series D-3 D-7 Preferred Units by such holders at the place designated in the notice of redemption.

If the Partnership gives a notice of redemption in respect of Series D-3 D-9 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-9 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-9 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-9 Preferred Units upon surrender of the Series D-3 D-9 Preferred Units by such holders at the place designated in the notice of redemption.

If the Partnership gives a notice of redemption in respect of Series D-3 D-12 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-12 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-12 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-12 Preferred Units upon surrender of the Series D-3 D-12 Preferred Units by such holders at the place designated in the notice of redemption.

If the Partnership gives a notice of redemption in respect of Series D-3 D-2 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-2 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-2 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-2 Preferred Units upon surrender of the Series D-3 D-2 Preferred Units by such holders at the place designated in the notice of redemption.

If the Partnership gives a notice of redemption in respect of Series D-3 D-5 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-5 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-5 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-5 Preferred Units upon surrender of the Series D-3 D-5 Preferred Units by such holders at the place designated in the notice of redemption.

Preferred Units. If the Partnership gives a notice of redemption in respect of Series D-3 D-4 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-4 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-4 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-4 Preferred Units upon surrender of the Series D-3 D-4 Preferred Units by such holders at the place designated in the notice of redemption. If a redemption is made in part and not in whole, it shall be made pro rata among the holders.

Preferred Units. If the Partnership gives a notice of redemption in respect of Series D-3 D-10 Preferred Units pursuant to this Section D(ii), then, by 12:00 noon, New York City time, on the Third Party Redemption Date, the Partnership will deposit irrevocably in trust for the benefit of the holders of Series D-3 D-10 Preferred Units being redeemed funds sufficient to pay the applicable amount payable with respect to such Series D-3 D-10 Preferred Units and will give irrevocable instructions and authority to pay such amount to the holders of the Series D-3 D-10 Preferred Units upon surrender of the Series D-3 D-10 Preferred Units by such holders at the place designated in the notice of redemption.
