Common use of Preliminary Engineering Study Clause in Contracts

Preliminary Engineering Study. The Participant agrees to complete the Preliminary Engineering Study and prepare a Draft Report and Final Report as set out in Section 5(b) hereof on the results of such Preliminary Engineering Study in accordance with (a) Exhibit B – Preliminary Engineering Study Minimum Requirements to the Program Rules; and (b) the Application. Any conflict or inconsistency between the Preliminary Engineering Study Funding Application, and the Proposal, on the one hand, and the Information Requests or IRs, on the other hand, shall be resolved in favour of the IRs unless otherwise provided by the IESO, and any conflict or inconsistency between the Preliminary Engineering Study Funding Application and the Proposal shall be resolved in favour of the Preliminary Engineering Study Funding Application. As of the date hereof, the Parties agree that the description of the Preliminary Engineering Study Funding Application set out at Schedule “B” is complete and accurate.
