Common use of Preliminary Injunctions Clause in Contracts

Preliminary Injunctions. Notwithstanding the provisions of Sections 7.10(b) through (g) of this Agreement, in the event any party hereto is seeking a pre-arbitral injunction, preliminary injunction or an order in aid of arbitration, each of the parties hereto agrees that jurisdiction and venue will be proper in the federal and state courts located in New York, New York and the Tokyo District Court located in Tokyo, Japan, and waives any objection based upon lack of personal jurisdiction or forum non conveniens, and agrees to submit to jurisdiction in each of such venues. The choice of forum set forth in this Section 7.10(g) shall not be deemed to preclude the seeking of a pre-arbitral injunction, preliminary injunction or order in aid of arbitration in any other appropriate jurisdiction.
