Common use of Preliminary Injunctions Clause in Contracts

Preliminary Injunctions. Nothing in this Agreement shall prevent either Party from seeking provisional measures from any court of competent jurisdiction in order to prevent immediate and irreparable injury, loss, or damage on a provisional basis, pending the decision of the arbitrator(s) on the ultimate merits of any Dispute.

Preliminary Injunctions. Nothing Notwithstanding anything in this Agreement to the contrary, nothing in this Agreement shall prevent either Party from seeking provisional measures from any court of competent jurisdiction in order to prevent immediate and irreparable injury, loss, or damage on a provisional basis, pending the decision of the arbitrator(s) arbitrators on the ultimate merits of any Dispute. Any such request shall not be deemed incompatible with the agreement to arbitrate or a waiver of the right to arbitrate.
