Prevalence. Unless otherwise expressly agreed upon in this Agreement, the terms of this Agreement shall supersede without exception. In case the terms of this Agreement conflict with the terms of any present or future request from Licensee concerning the PDK hereunder (including other DKLA’s), the terms of this Agreement shall prevail. Licensee agrees that its acceptance of delivery of any PDK from IMEC is conclusive evidence of Licensee's agreement that the license for such PDK is governed exclusively by the terms of this Agreement. More specifically, in case of conflict between an Annex and the terms and conditions of any other document or agreement, except for this Agreement, the Annex shall prevail.
Prevalence. In case of any dispute arising out of or in connection with the Sinqia’s bylaws, this arbitration agreement shall be applicable and shall prevail over the provisions of Section VIII, Article 33 of the bylaws in case of any discrepancy or incompatibility.

All the provisions of this Partnership Agreement, as such may have been amended by the Parties from time to time, and which are not expressly modified by the terms of a given Project Addendum, are incorporated by reference in such Project Addendum and shall apply to it and to its performance. A Project Addendum (together with its exhibits and all applicable provisions of the Partnership Agreement) represents the entire agreement between the Parties with respect to the corresponding R&D Project and supersedes all prior oral or written communications or understandings between the Parties with respect to such subject matter. In case of inconsistency between the terms of the Partnership Agreement and a given Project Addendum, the provisions of such Project Addendum shall prevail with respect to the corresponding R&D Project.
Prevalence. 2.1.1. In the event of a conflict between this Quality Agreement and the Manufacturing and Supply Agreement, Manufacturing and Supply Agreement shall prevail, with respect to non-quality related terms, and this Quality Agreement shall govern with respect to all quality related terms. For the avoidance of doubt if any provisions of this Quality Agreement and/or the Supply Agreement are inconsistent with the terms of the GMP and/or other applicable regulations, such regulations prevail.
Prevalence. Depression is widely prevalent in the adult population; in the National Comorbidity Survey the prevalence estimate for current major depression was 4.9% and for lifetime major depression was 17% (Blazer et al., 1994). These rates may be biased by recall problems. In a recent study, an indirect estimation method was used to estimate lifetime prevalence in Australia and the Netherlands. For both countries the model estimated that the lowest proportion of cases was much higher: 30% for men and 40% for women (Kruijshaar et al, 2005). In the elderly prevalence of major depression is much less, namely around 3%. But when less rigorous diagnostic criteria are used, 8 – 15% suffers from subclinical or minor depression (▇▇▇▇▇▇▇, 1995; ▇▇▇▇▇▇▇, ▇▇▇▇▇▇▇▇ & ▇▇▇▇▇▇, 1999; ▇▇▇▇▇▇ 1987; ▇▇▇▇▇ & ▇▇▇▇▇▇▇▇▇▇, 2000). In our rapidly aging population the absolute number of cases will become a large burden for the mental health care system. In 2007 for instance, 2,348,243 Dutch citizens (14.4% of the total population) will be over 65 years, and in 2017 this number will have risen to 3,002,165 (18% of the total population) (statistics from Central Bureau for Statistics, 2007). By that time the number of elderly individuals that need treatment for major and minor depression will have increased 28% (375,713 in 2007 versus 480,336 in 2017). These figures underscore the importance of prevention of depression, not only for the elderly but for the whole population.
Prevalence. The provisions of the Key Commercial Terms and the Clauses of the GTCs are to be read as mutually explanatory one of another, but in case of conflict, discrepancy in or divergence between the provisions of the Key Commercial Terms and the Clauses of this Agreement, the provisions of the Key Commercial Terms shall prevail.
Prevalence. 9.1 To the extent that the terms of this Agreement are inconsistent with the any other communications or materials, the terms of this Agreement shall prevail.
