PREVENTION OF DUMPING. 1. Each Party undertakes: (a) not to dump radioactive wastes and other ra- dioactive matter at sea anywhere within the South Pacific Nuclear Free Zone. (b) to prevent the dumping of radioactive wastes and other radioactive matter by anyone in its territorial sea; (c) not to take any action to assist or encourage the dumping by anyone of radioactive wastes and other radioactive matter at sea anywhere within the South Pacific Nuclear Free Zone; (d) to support the conclusion as soon as possible of the proposed Convention relating to the protection of the natural resources and envi- ronment of the South Pacific region and its Protocol for the prevention of pollution of the South Pacific region by dumping, with the aim of precluding dumping at sea of ra- dioactive wastes and other radioactive mat- ter by anyone anywhere in the region. 2. Paragraphs l(a) and l(b) of this Article shall not apply to areas of the South Pacific Nuclear Free Zone in respect of which such a Convention and Protocol have entered into force.

PREVENTION OF DUMPING. The 1984 Tuvalu Forum did not stipulate that the Treaty should prohibit the dumping of radioactive waste at sea. The decision to include Article 7, prohibiting dumping of such waste, reflects the growing concern of Forum members that their region should not be used as a dumping site. Henceforth the radioactive waste generated by many Forum members in medical, industrial and research activities will have to be disposed of on land, or exported from the region for disposal elsewhere. The dumping of “high-level radioactive wastes” at sea is already prohibited by the London Dumping Convention. Nauru and Kiribati, with support from other Forum members who are also parties to that Convention (notably Australia and New Zealand) are currently attempting to amend it to have it also prohibit the dumping of waste containing lesser levels of radioactivity. A moratorium was declared in 1983 on the dumping at sea of all radioactive wastes while the proposal is considered. In the South Pacific, the question of dumping has also been scrutinised during several rounds of negotiations on a draft “Convention for the Protection and Development of the Natural Resources and Environment of the South Pacific Region” and associated protocols. The negotiations have included all members of the South Pacific Commission, a regional organisation composed of Forum members as well as France, the United Kingdom and the United States — the last three qualifying because of their possession of territories in the South Pacific. The working group did not want to complicate those negotiations since they include states that not only play a major role in the LDC debate, but also are among the only states that might want to undertake major radioactive waste dumping operations in the region. The negotiations will therefore lead, if successful, to a Convention containing a generally accepted prohibition on dumping. So the working group chose not to draft a protocol to the SPNFZ Treaty inviting non­ Forum members to agree not to dump within the zone. It made that choice in recognition of the fact that such a move might have been seen to reflect a lack of commitment to the continuing negotiations. Similarly, the Treaty does not oblige parties to prevent dumping of radioactive wastes in their exclusive economic zones in addition to their territorial seas, although they have the power to do so under Article 210(5) of UNCLOS.   • PREVENTION OF BRIBERY 29.1 The Supplier represents and warrants that neither it, nor to the best of its knowledge any Supplier's Personnel, have at any time prior to the Commencement Date:‌ (a) committed a Prohibited Act or been formally notified that it is subject to an investigation or prosecution which relates to an alleged Prohibited Act; and/or (b) been listed by any government department or agency as being debarred, suspended, proposed for suspension or debarment, or otherwise ineligible for participation in government procurement programmes or contracts on the grounds of a Prohibited Act. 29.2 The Supplier shall not during the term of this agreement:‌ (a) commit a Prohibited Act; and/or (b) do or suffer anything to be done which would cause the Authority or any of the Authority's employees, consultants, contractors, sub- contractors or agents to contravene any of the Bribery Act or otherwise incur any liability in relation to the Bribery Act. 29.3 The Supplier shall during the term of this agreement: (a) establish, maintain and enforce, and require that its Sub- contractors establish, maintain and enforce, policies and procedures which are adequate to ensure compliance with the Bribery Act and prevent the occurrence of a Prohibited Act; and‌ (b) keep appropriate records of its compliance with its obligations under clause 29.3(a) and make such records available to the Authority on request. 29.4 The Supplier shall immediately notify the Authority in writing if it becomes aware of any breach of clause 29.1 and/or clause 29.2, or has reason to believe that it has or any of the Supplier's Personnel have:‌ (a) been subject to an investigation or prosecution which relates to an alleged Prohibited Act; (b) been listed by any government department or agency as being debarred, suspended, proposed for suspension or debarment, or otherwise ineligible for participation in government procurement programmes or contracts on the grounds of a Prohibited Act; and/or (c) received a request or demand for any undue financial or other advantage of any kind in connection with the performance of this agreement or otherwise suspects that any person or Party directly or indirectly connected with this agreement has committed or attempted to commit a Prohibited Act. 29.5 If the Supplier makes a notification to the Authority pursuant to clause 29.4, the Supplier shall respond promptly to the Authority's enquiries, co-operate with any investigation, and allow the Authority to audit any books, records and/or any other relevant documentation in accordance with clause 22. 29.6 If the Supplier is in Default under clause 29.1 and/or clause 29.2, the Authority may by notice:‌ (a) require the Supplier to remove from performance of this agreement any Supplier's Personnel whose acts or omissions have caused the Default; or (b) immediately terminate this agreement. 29.7 Any notice served by the Authority under clause 29.6 shall specify the nature of the Prohibited Act, the identity of the Party who the Authority believes has committed the Prohibited Act and the action that the Authority has elected to take (including, where relevant, the date on which this agreement shall terminate).

  • Prevention of Corruption The Contractor shall not offer, give, or agree to give anything, to any person an inducement or reward for doing, refraining from doing, or for having done or refrained from doing, any act in relation to the obtaining or execution of the Contract or for showing or refraining from showing favour or disfavour to any person in relation to the Contract.

  • Prevention of Fraud D2.1 The Contractor shall take all reasonable steps, in accordance with Good Industry Practice, to prevent Fraud by Staff and the Contractor (including its shareholders, members, directors) in connection with the receipt of monies from the Authority.

  • Prevention of and release from arrest Each Borrower shall promptly discharge: (a) all liabilities which give or may give rise to maritime or possessory liens on or claims enforceable against the Ship owned by it, the Earnings or the Insurances; (b) all taxes, dues and other amounts charged in respect of the Ship owned by it, the Earnings or the Insurances; and (c) all other outgoings whatsoever in respect of the Ship owned by it, the Earnings or the Insurances, and, forthwith upon receiving notice of the arrest of the Ship owned by it, or of its detention in exercise or purported exercise of any lien or claim, that Borrower shall procure its release by providing bail or otherwise as the circumstances may require.

  • PREVENTION OF FRAUD AND ▇▇▇▇▇▇▇ 37.1 The Supplier represents and warrants that neither it, nor to the best of its knowledge any Supplier Personnel, have at any time prior to the Framework Commencement Date: 37.1.1 committed a Prohibited Act or been formally notified that it is subject to an investigation or prosecution which relates to an alleged Prohibited Act; and/or 37.1.2 been listed by any government department or agency as being debarred, suspended, proposed for suspension or debarment, or otherwise ineligible for participation in government procurement programmes or contracts on the grounds of a Prohibited Act. 37.2 The Supplier shall not during the Framework Period: 37.2.1 commit a Prohibited Act; and/or 37.2.2 do or suffer anything to be done which would cause the Authority or any of the Authority’s employees, consultants, contractors, sub- contractors or agents to contravene any of the Relevant Requirements or otherwise incur any liability in relation to the Relevant Requirements. 37.3 The Supplier shall during the Framework Period: 37.3.1 establish, maintain and enforce, and require that its Sub-Contractors establish, maintain and enforce, policies and procedures which are adequate to ensure compliance with the Relevant Requirements and prevent the occurrence of a Prohibited Act; 37.3.2 keep appropriate records of its compliance with its obligations under Clause 37.3.1 and make such records available to the Authority on request; 37.3.3 if so required by the Authority, within twenty (20) Working Days of the Framework Commencement Date, and annually thereafter, certify in writing to the Authority, the compliance with this Clause 37.3 of all persons associated with the Supplier or its Sub-Contractors who are responsible for supplying the Goods and/or Services in connection with this Framework Agreement. The Supplier shall provide such supporting evidence of compliance as the Authority may reasonably request; and 37.3.4 have, maintain and where appropriate enforce an anti-bribery policy (which shall be disclosed to the Authority on request) to prevent it and any Supplier Personnel or any person acting on the Supplier's behalf from committing a Prohibited Act. 37.4 The Supplier shall immediately notify the Authority in writing if it becomes aware of any breach of Clause 37.1, or has reason to believe that it has or any of the Supplier Personnel has: 37.4.1 been subject to an investigation or prosecution which relates to an alleged Prohibited Act; 37.4.2 been listed by any government department or agency as being debarred, suspended, proposed for suspension or debarment, or otherwise ineligible for participation in government procurement programmes or contracts on the grounds of a Prohibited Act; and/or 37.4.3 received a request or demand for any undue financial or other advantage of any kind in connection with the performance of this Framework Agreement or otherwise suspects that any person or Party directly or indirectly connected with this Framework Agreement has committed or attempted to commit a Prohibited Act. 37.5 If the Supplier makes a notification to the Authority pursuant to Clause 37.4, the Supplier shall respond promptly to the Authority's enquiries, co-operate with any investigation, and allow the Authority to audit any books, records and/or any other relevant documentation in accordance with Clause 15 (Records, Audit Access and Open Book Data). 37.6 If the Supplier breaches Clause 37.1, the Authority may by notice: 37.6.1 require the Supplier to remove from the performance of this Framework Agreement any Supplier Personnel whose acts or omissions have caused the Supplier’s breach; or 37.6.2 immediately terminate this Framework Agreement for material Default. 37.7 Any notice served by the Authority under Clause 37.6 shall specify the nature of the Prohibited Act, the identity of the Party who the Authority believes has committed the Prohibited Act and the action that the Authority has elected to take (including, where relevant, the date on which this Framework Agreement shall terminate).
