Primary and Excess Policies Clause Samples

The "Primary and Excess Policies" clause defines the order in which multiple insurance policies will respond to a claim, distinguishing between primary coverage, which pays first, and excess coverage, which only pays after the primary policy limits are exhausted. In practice, this clause clarifies which insurer is responsible for initial payments and which will cover additional amounts if the loss exceeds the primary policy's limits. Its core function is to prevent disputes and overlapping payments by establishing a clear hierarchy of insurance coverage, ensuring that claims are handled efficiently and according to the parties' expectations.
