Common use of Primary and Noncontributory Clause in Contracts

Primary and Noncontributory. With the exception of Workers’ Compensation and Professional Liability insurance, the coverages to be maintained by Contractor shall be primary, and any insurance or self-insurance maintained by the District shall be excess only, and shall not be required to contribute with it.
