Common use of Prior Occupancy Clause in Contracts

Prior Occupancy. Landlord may authorize Tenant to take possession of all or any part of the Additional Premises prior to the Additional Premises Commencement Date. If Tenant does take possession pursuant to authority so given, all of the covenants and conditions of the Lease shall apply to and shall control such occupancy, except for the obligation to pay the Additional Premises Base Rent. Additional Rent for such occupancy shall be paid upon occupancy and on the first of each calendar month thereafter, as determined in accordance with Paragraph 4 above. If the Additional Premises are occupied for a fractional month, the Additional Rent applicable to the Additional Premises shall be prorated on a per diem basis.
