Common use of Prior to or concurrently with the execution and delivery of this Agreement Clause in Contracts

Prior to or concurrently with the execution and delivery of this Agreement. the Purchase Contract Agent, on behalf of the initial Holders of the Equity Security Units, shall cause the Notes comprising a part of the Equity Security Units to be Transferred to the Securities Intermediary for credit to the Collateral Account.
