Common use of Priorities not affected Clause in Contracts

Priorities not affected. Except as otherwise provided in this Deed the priorities referred to in Clause 2.1 (Ranking) and Clause 3.1 (Ranking) will: (a) not be affected by any reduction or increase in the principal amount secured by the Transaction Security in respect of the Secured Liabilities owing to the Creditors or by any intermediate reduction or increase in, or by any variation or satisfaction of, any of the Secured Liabilities or by any amendment or variation to any of the Debt Documents or any other circumstances; (b) apply regardless of the order in which or dates upon which this Deed and the other Debt Documents are executed or registered or notice of them is given to any person; and (c) secure the Secured Liabilities owing to the Creditors in the order specified, regardless of the date upon which any of the Secured Liabilities arise or of any fluctuations in the amount of any of the Secured Liabilities outstanding.

Except as otherwise provided in this Deed the priorities referred to in Clause 2.1 2 (RankingRanking and Priority) and Clause 3.1 8 (RankingApplication of Proceeds) will: (a) 19.4.1 not be affected by any reduction or increase in the principal amount secured by the Transaction Security Collateral in respect of the Secured Liabilities owing to Obligations of the Creditors Lenders or by any intermediate reduction or increase in, amendment or variation to any of the Transaction Documents, or by any variation or satisfaction of, any of the Secured Liabilities or by any amendment or variation to any of the Debt Documents Obligations or any other circumstances; (b) 19.4.2 apply regardless of the order in which or dates upon which the Transaction Documents and this Deed and the other Debt Documents are executed or registered or notice of them is given to any person; and (c) 19.4.3 secure the Secured Liabilities owing to the Creditors Obligations in the order specified, regardless of the date upon which any of the Secured Liabilities Obligations arise or of any fluctuations in the amount of any of the Secured Liabilities Obligations outstanding.
