Common use of Priority 3 Areas Clause in Contracts

Priority 3 Areas. 6.5.1 Contractor shall submit final Property Identification Plans in accordance with the Contract Documents specifying the limits and property interest of each Priority 3 Area for which it requires access to perform the Work. Access to the Priority 3 Areas will be based on a right-of-entry obtained by Owner from Fairfax County. 6.5.2 Except as provided in Section 6.5.3, Owner shall provide Contractor access to the Priority 3 Areas to perform any portion of the Work within such areas no later than three (3) months from Notice to Proceed. 6.5.3 With respect to Parcel 223 of the Priority 3 Areas (excluding those areas specifically related to the Traction Power Substation 13 and Stormwater Management Pond 2-5, that Owner will provide access to pursuant to Section 6.5.2), Owner shall provide Contractor access to such areas: (a) no later than thirty (30) months from Notice to Proceed if Contractor submitted the applicable final Property Identification Plan within eighteen (18) months from Notice to Proceed. (b) no later than twelve (12) months after submission of the applicable final Property Identification Plan if Contractor submitted such Property Identification Plan after eighteen (18) months from Notice to Proceed.
