PRIVACY CLAUSE. The Hirer is hereby reminded to read and understand before agreeing to be bound by the Privacy Notice of AmBank Group (which is available at ▇▇▇.▇▇▇▇▇▇▇▇▇▇▇.▇▇▇) and the clauses herein, as may relate to the processing of the Hirer's personal information. For the avoidance of doubt, the ▇▇▇▇▇ agrees that the said Privacy Notice shall be deemed to be incorporated by reference into this Terms and Conditions. In the event the Hirer provides personal and/or financial information relating to third parties, including but not limited to information relating to the Hirer's next-of-kin, dependants, authorized signatories, directors, shareholders, officers, and security parties for the purpose of the Facility, the Hirer: (a) confirm that the Hirer has obtained their consent or are otherwise entitled to provide the information to the Owner and for the Owner to use it in accordance with this Terms and Conditions and to provide information on the Owner's products, services and/or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Owner and/or entity within AmBank Group believe may be of interest and/or beneficial to them; (b) agree to ensure that the personal and financial information of the said third parties is accurate; (c) agree to update the Owner in writing in the event of any material change to the said personal and financial information; and (d) agree to the Owner's right to terminate the Facility should such consent be withdrawn by any of the said third parties. Where the Hirer instructs the Owner to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Owner's agents abroad, overseas regulators and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing the Owner and/or the Owner's agents to enter into any cross-border transaction on the Hirer's behalf, the Hirer agrees to the above said disclosures on behalf of the Hirer and others involved in the said cross-border transaction. Subject always to any laws (including regulations, guidelines and/or obligations) applicable to the Owner (whether in or outside Malaysia), the Hirer agrees that other companies in the AmBank Group, their merchants and strategic partners may contact the Hirer about products, services and offers, which the Owner and AmBank Group believe may be of interest or beneficial to the Hirer. The Owner and AmBank Group may communicate with the Hirer through various channels, including telephone, e-mail, electronic or mobile messaging, facsimile or post, using the contact information the Hirer has provided. The Hirer acknowledges that certain communications such as the statements of Facility to the Hirer and AmBank Group's websites may contain standard information regarding other products and services of the Owner and the AmBank Group that cannot be removed without affecting the delivery or operation provision of the Facility and/or without additional costs to the Hirer. The Owner may use a credit reporting agency to help make decisions, for example when the Owner need to: (a) check details on applications for the Facility, financing and financing-related or other facilities granted to the Hirer; (b) managing and reviewing the Facility; and/or (c) recover debts owed by the Hirer. The Hirer will be linked by credit reporting agencies to any other names the Hirer uses or may had used, and any joint and several applicants. The Owner may also share information about the Hirer and how Hirer manages the Facility with relevant credit reporting agencies. Even after the Hirer has provided the Owner with any information, the Hirer will have the option to withdraw the consent given earlier. In such instances, the Owner will have the right to not provide or discontinue the provision of the Facility that is/are linked with such information.

(b) In the event the Hirer provides Customer provide personal and/or financial information relating to third parties, including but not limited to information relating to the Hirer's Customer’s next-of-kin, dependants, authorized authorised signatories, directors, shareholders, officers, and security parties Security Parties for the purpose of the Facility, the Hirer: (a) Customer: i. confirm that the Hirer Customer has obtained their consent or are otherwise entitled to provide the information to the Owner Bank and for the Owner Bank to use it in accordance with this Terms and Conditions Letter of Offer and to provide information on the Owner's Bank’s products, services and/or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Owner Bank and/or entity within AmBank Group believe may be of interest and/or beneficial to them; (b) ; ii. agree to ensure that the personal and financial information of the said third parties is accurate; (c) ; iii. agree to update the Owner Bank in writing in the event of any material change to the said personal and financial information; and (d) and iv. agree to the Owner's Bank’s right to terminate the Facility should such consent be withdrawn by any of the said third parties. (c) Where Customer instruct the Hirer instructs the Owner Bank to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Owner's Bank’s agents abroad, overseas regulators and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). Agreement. 16.2 In the event the Hirer Customer provides personal and/or and financial information relating to third parties, including but not limited to information relating to the Hirer's Customer’s next-of-kin, dependants, authorized signatories, kin and dependents (where the Customer is an individual) or information relating to the Customer’s directors, shareholders, officers, individual guarantors and security parties providers (where the Customer is a corporation), for the purpose of opening or operating the FacilityCustomer’s account(s)/facility(ies) with the Bank or otherwise subscribing to the Bank’s products and services, the Hirer: Customer (a) confirm confirms that the Hirer Customer has obtained their consent or are is otherwise entitled to provide the this information to the Owner Bank and for the Owner Bank to use it in accordance with this Terms and Conditions and to provide information on the Owner's products, services and/or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Owner and/or entity within AmBank Group believe may be of interest and/or beneficial to themagreement; (b) agree to ensure that the personal and financial information of the said third parties is accurate; (c) agree to update the Owner Bank in writing in the event of any material change to the said personal and financial information; and (d) agree to the Owner's Bank’s right to terminate the Facility this agreement should such consent be withdrawn by any of the said third parties. . 16.3 Where the Hirer Customer instructs the Owner Bank to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Owner's agents abroad, overseas regulators and/or and authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing the Owner Bank and/or the Owner's Bank’s agents to enter into any cross-border transaction on behalf of the Hirer's behalfCustomer, the Hirer Customer agrees to the above said disclosures on behalf of the Hirer Customer and others involved in the said cross-cross- border transaction. The Hirer Customer will be linked by credit reporting reporting/reference agencies to any other names the Hirer Customer uses or may had has used, and any joint and several applicants. The Owner Bank may also share information about the Hirer Customer and how Hirer the Customer manages the Facility Customer’s account(s)/facility(ies) with relevant credit reporting reporting/reference agencies. . 16.5 Even after the Hirer Customer has provided the Owner Bank with any information, the Hirer Customer will have the option to withdraw the consent given earlier. In such instances, the Owner Bank will have the right to not provide or discontinue the provision of the Facility any product, service, account(s) and/or facility(ies) that is/are linked with such information. 16.6 The Bank reserves the right to amend this clause from time to time at the Bank’s sole discretion and shall provide prior notification to the Customer in writing and place any such amendments on the Bank’s websites and/or by placing notices at the banking halls or at prominent locations within the Bank’s branches. 16.7 For the purposes of this Clause, the CIMB Group consists of CIMB Group Holdings Berhad and all its related companies as defined in ▇▇▇ ▇ ▇▇ ▇▇▇ ▇▇▇▇▇▇▇▇▇ ▇▇▇ ▇▇▇▇ and jointly controlled companies that provide financial and other regulated services, excluding companies, branches, offices and other forms of presence operating outside Malaysia, and the use of the words “ the Bank” and “ the Bank’s” are to be read as references to the CIMB Group. 16.8 This clause shall be without prejudice to any other clause in this Agreement which provides for the disclosure of information. (b) In the event the Hirer provides Chargor and/or Customer provide personal and/or financial information relating to third parties, including but not limited to information relating to the Hirer's Chargor and/or Customer’s next-of-kin, dependants, authorized authorised signatories, directors, shareholders, officers, and security parties Security Parties for the purpose of the Facility, the Hirer: Chargor and/or Customer: (ai) confirm that the Hirer Chargor and/or Customer has obtained their consent or are otherwise entitled to provide the information to the Owner Chargee and for the Owner Chargee to use it in accordance with this Terms and Conditions Letter of Offer and to provide information on the Owner's Chargee’s products, services and/or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Owner Chargee and/or entity within AmBank Group believe may be of interest and/or beneficial to them; ; (bii) agree to ensure that the personal and financial information of the said third parties is accurate; ; (ciii) agree to update the Owner Chargee in writing in the event of any material change to the said personal and financial information; and and (div) agree to the Owner's Chargee’s right to terminate the Facility should such consent be withdrawn by any of the said third parties. . (c) Where the Hirer instructs Chargor and/or Customer instruct the Owner Chargee to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Owner's Chargee’s agents abroad, overseas regulators and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing the Owner Chargee and/or the Owner's our agents to enter into any cross-border transaction on the Hirer's Chargor and/or Customer’s behalf, the Hirer agrees Chargor and/or Customer agree to the above said disclosures on behalf of the Hirer Chargor and/or Customer and others involved in the said cross-border transaction. Subject . (d) Additionally, but always subject to any laws laws, (including regulations, guidelines and/or obligations) applicable to the Owner Chargee (whether in or outside Malaysia), the Hirer agrees Chargor and/or Customer agree that other companies in the AmBank Group, their merchants and strategic partners may contact the Hirer Chargor and/or Customer about products, services and offers, which the Owner Chargee and AmBank Group believe may be of interest or beneficial to the Hirer. (e) The Owner Chargee and AmBank Group may communicate with the Hirer Chargor and/or Customer through various channels, including telephone, e-mail, electronic or / mobile messaging, facsimile or post, using the contact information the Hirer Chargor and/or Customer has provided. . The Hirer Chargor and/or Customer acknowledges that certain communications such as the statements of Facility to the Hirer Chargor and/or Customer and AmBank Group's ’s websites may contain standard information regarding other products and services of the Owner Chargee and the AmBank Group that cannot be removed without affecting the delivery or / operation provision of the Facility and/or without additional costs to the Hirer. Chargor and/or the Customer. (h) The Owner Chargee may use a credit reporting agency to help make decisions, for example when the Owner need Chargee needs to: : (ai) check details on applications for the Facility, financing and financing-related or other facilities granted to the Hirer; Chargor and/or the Customer; (bii) managing and reviewing the Facility; and/or and/or (ciii) recover debts owed by the Hirer. Chargor and/or the Customer. (i) The Hirer Chargor and/or Customer will be linked by credit reporting agencies to any other names the Hirer uses Chargor and/or Customer use or may had used, and any joint and several applicants. The Owner Chargee may also share information about the Hirer Chargor and/or the Customer and how Hirer manages the Chargor and/or the Customer manage the Facility with relevant credit reporting agencies. . (j) Even after the Hirer has Chargor and/or Customer have provided the Owner Chargee with any information, the Hirer Chargor and/or Customer will have the option to withdraw the consent given earlier. In such instances, the Owner Chargee will have the right to not provide or discontinue the provision of the Facility that is/are linked with such information. (k) The Chargee reserves the right to amend this Section from time to time at the Chargee’s sole discretion by providing notice to the Chargor and/or Customer. (l) This clause shall be without prejudice to Section 11.14 (Disclosure of Information) of this Charge.

PRIVACY CLAUSE. (b) In the event Customer and/or the Hirer provides Assignor provide personal and/or financial information relating to third parties, including but not limited to information relating to the Hirer's Customer and/or the Assignor’s next-of-kin, dependants, authorized authorised signatories, directors, shareholders, officers, and security parties Security Parties for the purpose of the Facility, the Hirer: Customer and/or the Assignor: (ai) confirm that the Hirer Customer and/or the Assignor has obtained their consent or are otherwise entitled to provide the information to the Owner Bank and for the Owner Bank to use it in accordance with this Terms and Conditions the Letter of Offer and to provide information on the Owner's Bank’s products, services and/or offers (inclusive of the products, services and offers of the other entities within AmBank Group) which the Owner Bank and/or entity within AmBank Group believe may be of interest and/or beneficial to them; ; (bii) agree to ensure that the personal and financial information of the said third parties is accurate; ; (ciii) agree to update the Owner Bank in writing in the event of any material change to the said personal and financial information; and and (div) agree to the Owner's Bank’s right to terminate the Facility should such consent be withdrawn by any of the said third parties. . (c) Where Customer and/or the Hirer instructs Assignor instruct the Owner Bank to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-cross- border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Owner's Bank’s agents abroad, overseas regulators and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing the Owner Bank and/or the Owner's our agents to enter into any cross-border transaction on the Hirer's Customer and/or the Assignor’s behalf, the Hirer agrees Customer and/or the Assignor agree to the above said disclosures on behalf of the Hirer Customer and/or the Assignor and others involved in the said cross-border transaction. (k) The Bank reserves the right to amend this Clause from time to time at the Bank’s sole discretion by providing notice to the Customer and/or the Assignor. (l) This clause shall be without prejudice to Clause 13.13 (Disclosure of Information) of this Assignment.
