Common use of Privacy Statements Clause in Contracts

Privacy Statements. The Banks (A) comply in all material respects with the Privacy Statements (as defined below) as applicable to any given set of personal information collected by the Banks from Individuals (as defined below), (B) comply in all material respects with all applicable federal, state, local and foreign laws and regulations regarding the collection, retention, use, transfer or disclosure of personal information, and (C) take reasonable measures as are customary in the business in which the Banks and their subsidiaries are engaged to protect and maintain the confidential nature of the personal information provided to the Banks by Individuals in accordance with the terms of the applicable Privacy Statements. To the Company’s knowledge, no claim or controversy has arisen or been threatened regarding the Privacy Statements or the implementation thereof. As used herein, “Privacy Statements” means, collectively, any and all of the Banks’ privacy statements and policies published on Bank websites or products or otherwise made available by the Banks regarding the collection, retention, use and distribution of the personal information of an individual, including, without limitation, from visitors or users of any Bank websites or products (“Individuals”).

To the Company’s knowledge, no claim or controversy has arisen or been threatened regarding the Privacy Statements or the implementation thereof.
