Common use of Privacy Statements Clause in Contracts

Privacy Statements. The Borrowers (a) comply in all respects with the Privacy Statements as applicable to any given set of Personal Information collected from individuals; (b) comply in all respects with applicable privacy laws, rules and regulations regarding the collection, retention, use and disclosure of Personal Information; and (c) take reasonable measures to protect and maintain the confidential nature of the Personal Information provided by individuals, in accordance with the terms of the applicable Privacy Statements, except in the case of each of clauses (a), (b) and (c) where the failure to comply or to take such measures could not reasonably be expected to result in a Material Adverse Effect.
