PRIVATE PROPERTIES. It is the Design/Builds responsibility to properly protect private properties at all times and to restore any disturbed areas to their pre-existing condition, or better. Any areas of private property that are damaged by the Design/Build’s actions shall be repaired by the Design/Build at no cost to Area Cooperative Educational Services (ACES).
PRIVATE PROPERTIES. Private landowners are encouraged to participate in the Public Art process and to incorporate Public Art in the development of their property. Town staff will endeavour to work with external partners and property owners to include the integration of Public Artworks on their properties. Public Art located on these properties may be encompassed in the policy.

  • Separate Property With respect to property acquired prior to the marriage, each Party’s property listed in Exhibit A and Exhibit B will remain as the respective Party’s non-marital, separate and individual property during and after the marriage, including any increase in the value relating to the property. Each Party will have the full right and authority to manage, sell, gift, transfer or otherwise dispose of his or her separate property. However, the following property will be considered the marital property of both Parties:

  • Real Properties The Company does not have an interest in any real property, except for the Leases (as defined below).

  • The Properties Attached hereto as Schedule I is the description of certain Land (the "Subject Property"). Effective upon the execution and delivery of this Lease Supplement by Lessor and Lessee, such Land, together with any Building and other improvements thereon or which thereafter may be constructed thereon shall be subject to the terms and provisions of the Lease and Lessor hereby grants, conveys, transfers and assigns to the Related Lessee those interests, rights, titles, estates, powers and privileges provided for in the Lease with respect to the Subject Property.

  • Owned Properties The "Owned Real Property Schedule" attached hereto sets forth a list of all owned real property (the "Owned Real Property") used by the Company or any of it Subsidiaries in the operation of the Company's or any of it Subsidiaries' business. With respect to each such parcel of Owned Real Property and except for Liens in favor of the Senior Lenders: (i) such parcel is free and clear of all covenants, conditions, restrictions, easements, liens or other encumbrances, except Permitted Encumbrances; (ii) there are no leases, subleases, licenses, concessions, or other agreements, written or oral, granting to any person the right of use or occupance of any portion of such parcel; and (iii) there are no outstanding actions or rights of first refusal to purchase such parcel, or any portion thereof or interest therein.

  • Business and Properties No business of any Loan Party or any of its Subsidiaries is affected by any fire, explosion, accident, drought, storm, hail, earthquake, embargo, act of God or of the public enemy or other casualty (whether or not covered by insurance) that could reasonably be expected, individually or in the aggregate, to have a Material Adverse Effect.
