Procedure in Serious Cases. When an Employee is to be charged with a violation that is likely to result in the Employee receiving a suspension, demotion or dismissal, the following shall apply: A. The Employee shall be given a notice five (5) calendar days in advance of the hearing and that notice shall advise the Employee of the general nature of the suspected violation. B. The Employee shall be advised in the notice of his right to be represented by a Bargaining Unit representative at such hearing. Any written reprimand, suspension, demotion or dismissal may only be appealed through the grievance procedure as provided for in this Agreement. Disciplinary action must begin within twelve (12) calendar days of the Employer having, through diligence, knowledge of the occurrence of the incident giving rise to the discipline. Failure of the Employer to pursue discipline within the time limit set forth above bars the Employer from bringing discipline on the incident in the future or attaching it to a subsequent incident as discipline.
