Common use of Proceedings Pending Clause in Contracts

Proceedings Pending. (a) Any litigation, arbitration or administrative proceedings of or before any court, arbitral body or agency which has had or is likely to have a Material Adverse Effect is or are started or filed against any Obligor. (b) Any final (rechtskräftig) judgment of any litigation, arbitration or administrative proceedings of or before any court, arbitral body or agency adversely determined against an Obligor that exceeds an aggregate amount of thirty million (30,000,000) EUR (or its equivalent on the date of such judgment). (c) Any material collective labour dispute occurs which has or is reasonably likely to have a Material Adverse Effect.
