Proceedings Under ADEA. Section 5(a) shall not preclude the Executive from filing any complaint, charge or claim challenging the validity of the Executive's waiver of Claims arising under ADEA (which is set forth in Section 2(b) of this Release). However, both the Executive and the Company confirm their belief that the Executive's waiver of claims under ADEA is valid and enforceable, and that their intention is that all claims under ADEA will be waived.
