Process Must Provide for Transfer of Management Responsibilities. If there is a dispute regarding the performance of the Exchange Administrator’s or Board of Director’s responsibilities for management of the Exchange, dispute resolution processes shall provide a method whereby such management responsibilities can be transferred to a third party that is capable of continuing to implement this Agreement. Transfer of the management responsibilities to the third party shall include a transfer of the right to use Operating Funds in order to carry out all management responsibilities.

  • Acknowledgement of Services and Responsibility of the Manager The Resident acknowledges that neither the Manager nor the Institution stands in loco parentis with respect to the Resident. The Residence provides living accommodations for independent students who are to be responsible and accountable for their personal needs and their interactions with their fellow residents as opposed to residential care. The Manager is responsible for the maintenance and operation of the residence.
