Common use of Processor and Controller Responsibilities Clause in Contracts

Processor and Controller Responsibilities. The parties acknowledge and agree that: (a) Appendix 1 to the Agreement describes the subject matter and details of the processing of Customer Personal Data; (b) Bitrix24 is a processor (service provider under California Consumer Privacy Act of 2018) of Customer Personal Data under the Data Protection Legislation; (c) Customer is a controller or processor, as applicable, of Customer Personal Data under the Data Protection Legislation; and (d) each party will comply with the obligations applicable to it under the Data Protection Legislation with respect to the processing of Customer Personal Data; (e) Customer shall, in its use or receipt of the Services, Process Personal Data in accordance with the requirements of Data Protection Legislation and Customer will ensure that its instructions for the Processing of Personal Data shall comply with Data Protection Legislation. Customer shall have sole responsibility for the accuracy, quality, and legality of Personal Data and the means by which Customer acquired Personal Data.
