Procurement Instructions for Authorized Users. The following procurement instructions apply to all purchases by Authorized Users under the Contract. OGS reserves the right to change the instructions set forth in this section in non-material and substantive ways without seeking a contract amendment. Authorized Users should follow the following procurement instructions when purchasing from the Contract(s): A. Before proceeding with their purchase, Authorized Users shall check the list of Preferred Source offerings and are reminded that they must comply with State Finance Law, particularly § 162, regarding commodities/services provided by preferred source suppliers. Some Products in the resultant Contract are available from one or more Preferred Sources, including, but not limited to janitorial/cleaning supplies and Vehicle care Products (e.g., bug/tar remover, wash agents, carb/brake cleaner, diesel exhaust fluid, oil filters, lubricants, surface protectants, windshield washer fluid, windshield wipers, wheel cleaner and Vehicle covers); B. When utilizing the Contract(s), the Authorized User should be familiar with and follow the terms and conditions governing its use. The Authorized User is accountable and responsible for compliance with the requirements of public procurement processes. The Authorized User, when purchasing from OGS contracts, should hold the Contractor accountable for Contract compliance and meeting the Contract terms, conditions, specifications, and other requirements. Also, in recognition of market fluctuations over time, Authorized Users are encouraged to seek improved pricing whenever possible. Authorized Users have the responsibility to document purchases which should include: • A statement of need and associated requirements; • Obtaining all necessary prior approvals; • A summary of the Contract alternatives considered for the purchase; and • The reason(s) supporting the resulting purchase (e.g., show that basis for the selection among multiple Contracts at the time of purchase was the most practical and economical alternative and was in the best interests of the State). C. The resultant Contracts will be issued under a multiple award structure, and includes the Lots listed below. Pursuant to State Finance Law § 163(10)(c), at the time of purchase, Authorized Users must base their selection among multiple Contracts upon which is the most practical and economical alternative that is in the best interests of the State. Awarded Contractors’ Product offerings, Contract and pricing information will be posted to the OGS website at ▇▇▇▇://▇▇▇.▇▇.▇▇▇/purchase/spg/awards/3031023123CAN.HTM. The Authorized User shall determine the appropriate Lot to make its purchase from, and shall procure Products that best meet their form, function, and utility requirements.
