Common use of Procurement of Small Works Clause in Contracts

Procurement of Small Works. Works estimated to cost less than $100,000 equivalent per contract, up to an aggregate amount not to exceed $300,000 equivalent, may be procured under lump-sum, fixed-price contracts awarded on the basis of quotations obtained from three (3) qualified domestic contractors in response to a written invitation. The invitation shall include a detailed description of the works, including basic specifications, the required completion date, a basic form of agreement acceptable to the Association, and relevant drawings, where applicable. The award shall be made to the contractor who offers the lowest price quotation for the required work, and who has the experience and resources to complete the contract successfully. Procurement of all goods and works shall be undertaken in accordance with such procurement plan as shall have been approved by the Association, and with the provisions of said paragraph 1. 2. Prior Review (a) With respect to: (i) each contract awarded in accordance with the provisions of Section I, Part B of this Schedule; (ii) each contract awarded in accordance with the provisions of Section I, Part C.1 of this Schedule; and (iii) the first three contracts (each one from a different oblast) awarded in accordance with the provisions of Section I, Part C.4 of this Schedule, the procedures set forth in paragraphs 2 and 3 of Appendix 1 to the Guidelines shall apply. (b) With respect to the first two contracts awarded in accordance with the provisions of Section I, Parts C.2 and C.3 of this Schedule, the following procedures shall apply:

(b) prior to the execution of any contract procured under direct contracting or shopping procedures, the Borrower shall provide to the Association a copy of the specifications and the draft contract. 3. Post Review With respect to the first two contracts awarded in accordance with the provisions of Section I, Parts C.2 and C.3 each contract not governed by paragraph 2 of this SchedulePart, the following procedures set forth in paragraph 4 of Appendix 1 to the Guidelines shall apply:.

Works for Parts A and B of the Project, estimated to cost less than $100,000 50,000 equivalent per contract, up to an aggregate amount not to exceed $300,000 equivalent44,600,000 equivalent with respect to Part A of the Project and $12,800,000 equivalent with respect to Part B of the Project, may be procured under lump-sum, fixed-price contracts awarded on the basis of quotations obtained from three (3) qualified domestic contractors in response to a written invitation. The invitation shall include a detailed description of the works, including basic specifications, the required completion date, a basic form of agreement acceptable to the Association, and relevant drawings, where applicable. (b) With respect to the first two contracts awarded in accordance with the provisions of Section I, Parts C.2 and C.3 of this Schedule, the following procedures shall apply:

Prior Review (a) With respect to: (i) to each contract to be awarded in accordance with the provisions of Section Ipursuant to Parts B and C.1, Part B respectively, of this Schedule; (ii) each contract awarded in accordance with the provisions of Section I, Part C.1 of this Schedule; and (iii) the first three contracts (each one from a different oblast) awarded in accordance with the provisions of Section I, Part C.4 of this ScheduleSection, the procedures set forth in paragraphs 2 and 3 of Appendix 1 to the Guidelines shall apply. (b) With respect to the first two contracts contract to be awarded in accordance with the provisions of Section Ipursuant to Parts C.2, Parts C.2 C.3 and C.3 C.4, respectively, of this ScheduleSection, the following procedures shall apply: (i) prior to the selection of any supplier or contractor, as the case may be, the Recipient shall provide to the Bank a report on the comparison and evaluation of quotations received; (ii) prior to the execution of any contract procured under shopping procedures, the Recipient shall provide to the Bank a copy of the specifications and the draft contract; and (iii) the procedures set forth in paragraphs 2 (f), 2 (g) and 3 of Appendix 1 to the Guidelines shall apply.

Prior Review (a) With respect to: (i) to each contract awarded in accordance with the provisions of Section I, Part B of this Schedule; (ii) each contract awarded in accordance with the provisions of Section I, Part C.1 of this Schedule; and (iii) the first three contracts (each one from a different oblast) awarded in accordance with the provisions of Section I, Part C.4 of this Scheduleprocured under Parts B. 1 hereof, the procedures set forth in paragraphs 2 and 3 of Appendix 1 to the Guidelines shall apply. (b) With respect to each contract procured under Part C. 1 hereof and the first two contracts awarded in accordance with the provisions of Section I, procured under Parts C.2 and or C.3 of this Schedulehereof, the following procedures shall apply: (i) prior to the selection of any supplier or execution of any contract under shopping procedures the Borrower shall provide to the Bank a report on the comparison and evaluation of quotations received; (ii) prior to the selection of any supplier or execution of any contract procured under shopping procedures, the Borrower shall provide to the Bank a copy of the specifications and the draft contract; and (iii) the procedures set forth in paragraphs 2 (f) and 2 (g) and 3 of Appendix 1 to the Guidelines shall apply.

Procurement of Small Works. Works estimated to cost less than $100,000 equivalent per contractunder Part A.2 of the Project for the construction and installation of low voltage transmission lines, up to an aggregate amount not to exceed the equivalent of five hundred thousand dollars ($300,000 equivalent500,000), may be procured under lump-sum, fixed-lump sum fixed price contracts awarded on the basis of quotations obtained from three at least five (35) pre-qualified domestic contractors in response to a written invitation. The invitation shall include a detailed description of the works, including basic specifications, the required completion date, a basic form of agreement acceptable to the Association, and relevant drawings, drawings where applicable. The award shall be made to the contractor who offers the lowest price quotation for the required work, and who has the experience and resources to successfully complete the contract successfullycontract. Prior Review (a) Reviews With respect to: (i) to each contract awarded in accordance with for goods and works estimated to cost the provisions equivalent of Section I, Part B of this Schedule; five hundred thousand dollars (ii$500,000) each contract awarded in accordance with the provisions of Section I, Part C.1 of this Schedule; and (iii) the first three contracts (each one from a different oblast) awarded in accordance with the provisions of Section I, Part C.4 of this Scheduleor more, the procedures set forth in paragraphs 2 and 3 of Appendix 1 to the Guidelines shall apply. (b) With respect to each contract for goods estimated to cost the first two contracts awarded in accordance with the provisions equivalent of Section I, Parts C.2 and C.3 of this Schedule$20,000 or more, the following procedures shall apply: (i) prior to the selection of any supplier under shopping procedures, the Borrower shall provide to the Association a report on the comparison and evaluation of quotations received; (ii) prior to the execution of any contract procured under direct contracting or shopping procedures, the Borrower shall provide to the Association a copy of the specifications and the draft contract; and (iii) the procedures set forth in paragraphs 2 (f), 2 (g) and 3 of Appendix 1 to the Guidelines shall apply.

The invitation shall include a detailed description of the works, including basic specifications, the required completion date, a basic form of agreement acceptable to the Association, and relevant drawings, where applicable. The award shall be made to the contractor who offers the lowest price quotation for the required work, and who has the experience and resources to complete the contract successfully. (b) With respect to each contract for goods estimated to cost the first two contracts awarded in accordance with the provisions equivalent of Section I, Parts C.2 and C.3 of this Schedule$30,000 or more, the following procedures shall apply: (i) prior to the execution of any contract procured under direct contracting procedures with CPPA and the UN Agencies, the Borrower shall provide to the Association a copy of the specifications and the draft contract; and (ii) the procedures set forth in paragraphs 2 (f), 2 (g) and 3 of Appendix 1 to the Guidelines shall apply.

(b) With respect to the first two contracts awarded in accordance with the provisions of Section I, Parts C.2 and C.3 of this Schedule, the following procedures shall apply:

Works Civil works estimated to cost the equivalent of $30,000 or less than $100,000 equivalent per contract, up to an aggregate amount not to exceed exceeding $300,000 equivalent, 160,100,000 may be procured carried out either: (a) under lump-lump sum, fixed-fixed price contracts awarded on the basis of quotations obtained from three (3) qualified domestic contractors in response to a written invitation. The invitation shall include a detailed description of the works, including basic specifications, the required completion date, a basic form of agreement acceptable to the AssociationAssociation and the Bank, and relevant drawings, where applicable. The award shall be made to the contractor who offers the lowest price quotation for the required work, and who has the experience and resources to complete the contract successfully; or (b) through direct contracting with Water Users’ Associations, NGOs, or local participatory groups, in accordance with paragraph 3.7 of the Guidelines and procedures satisfactory to the Association and the Bank; or (c) through force account, as a last resort in accordance with paragraph 3.8 of the Guidelines and procedures satisfactory to the Association and the Bank. Part D: Review by the Association Bank of Procurement Decisions 1. Procurement Planning Prior to the issuance of any invitations to prequalify for bidding or to bid for contracts, the proposed procurement plan for the Project shall be furnished to the Association and the Bank for its their review and approval, in accordance with the provisions of paragraph 1 of Appendix 1 to the Guidelines. Procurement of all goods and works shall be undertaken in accordance with such procurement plan as shall have been approved by the Association, and with the provisions of said paragraph 1. 2. Prior Review (a) Review With respect to: (i) to each contract awarded in accordance with for goods estimated to cost the provisions equivalent of Section I, Part B of this Schedule; (ii) $200,000 or more and each contract awarded in accordance with for works estimated to cost the provisions equivalent of Section I, Part C.1 of this Schedule; and (iii) the first three contracts (each one from a different oblast) awarded in accordance with the provisions of Section I, Part C.4 of this Schedule$300,000 or more, the procedures set forth in paragraphs 2 and 3 of Appendix 1 to the Guidelines shall apply. (b) . ˇ3. Post Review With respect to the first two contracts awarded in accordance with the provisions of Section I, Parts C.2 and C.3 each contract not governed by paragraph 2 of this SchedulePart, the following procedures set forth in paragraph 4 of Appendix 1 to the Guidelines shall apply:.

Procurement of Small Works. Works estimated to cost less than $100,000 250,000 equivalent per contract, up to an aggregate amount not to exceed $300,000 1,600,000 equivalent, may be procured under lump-sum, fixed-price contracts awarded on the basis of quotations obtained from three (3) qualified domestic contractors in response to a written invitation. The invitation shall include a detailed description of the works, including basic specifications, the required completion date, a basic form of agreement acceptable to the AssociationBank, and relevant drawings, where applicable. The award shall be made to the contractor who offers the lowest price quotation for the required work, and who has the experience and resources to complete the contract successfully. Part D: Review by the Association Bank of Procurement Decisions 1. Procurement Planning Prior to the issuance of any invitations to prequalify for bidding or invitation to bid for contracts, the proposed procurement plan for the Project shall be furnished to the Association Bank for its review and approval, in accordance with the provisions of paragraph 1 of Appendix 1 to the Guidelines. Procurement of all goods and works shall be undertaken in accordance with such procurement plan as shall have been approved by the AssociationBank, and with the provisions of said paragraph 1. 2. Prior Review (a) With respect to: (i) to each contract awarded procured in accordance with Part B.1 above and the provisions of Section I, Part B of this Schedule; (ii) each contract awarded first two contracts procured in accordance with the provisions of Section I, Part C.1 of this Schedule; and (iii) the first three contracts (each one from a different oblast) awarded in accordance with the provisions of Section I, Part C.4 of this Scheduleabove, the procedures set forth in paragraphs 2 and 3 of Appendix 1 to the Guidelines shall apply. (b) With respect to the first two contracts awarded for computers, training materials, printing and distribution services, and school furniture to be procured in accordance with the provisions of Section I, Parts procedures referred to in Part C.2 above and with respect to contracts for textbooks and works estimated to cost less than $30,000 to be procured in accordance with the procedures referred to in Part C.3 of this Scheduleabove, the following procedures shall apply: (i) prior to the execution of the first two contracts each year under shopping procedures, the Borrower shall provide to the Bank a report on the comparison and evaluation of quotations received; (ii) prior to the execution of the first two contracts each year procured under shopping procedures, contracts for works procured under direct contracting, and contracts for books procured under direct contracting, the Borrower shall provide to the Bank a copy of the specifications and the draft contract; and (iii) the procedures set forth in paragraphs 2 (f), 2 (g) and 3 of Appendix 1 to the Guidelines shall apply.

(b) With respect to to: (a) first three contracts procured under Part C.2 of this Section; and (b) the first two contracts awarded in accordance with the provisions of Section I, procured under Parts C.2 C.3 and C.3 C.5 of this ScheduleSection, the following procedures shall apply: (i) prior to the selection of any supplier or the execution of any contract under shopping procedures the Borrower shall provide to the Association a report on the comparison and evaluation of quotations received; (ii) prior to the execution of any contract procured under direct contracting or shopping procedures, the Borrower shall provide to the Association a copy of the specifications and the draft contract; and (iii) the procedures set forth in paragraphs 2 (f) and 2 (g) and 3 of Appendix 1 to the Guidelines shall apply.
