Project and Quality Management. (a) The Concessionaire shall provide oversight and management of the Project to control the scope, quality, cost, and on-time delivery of the Work. If the Work does not satisfy the applicable performance or quality standards, the Concessionaire, at its sole cost and expense, shall increase and improve its management and oversight efforts such that repair or replacement of Nonconforming Work and satisfaction of applicable performance or quality standards do not require any increase in the Department’s limited oversight of the Project. (b) In accordance with this Agreement and the Technical Requirements, the Concessionaire shall be responsible for all quality assurance and quality control activities necessary to manage the development, design, construction, operation and maintenance of the Project and any Project Enhancement undertaken by the Concessionaire pursuant to Section 12.01 or 12. (c) The Concessionaire shall prepare and submit to the Department for its review and approval the Project Development Plans in accordance with the requirements and times set forth in the Technical Requirements. (d) The Concessionaire shall require each of its Contractors and suppliers at every level to comply with the requirements of the Project Development Plans, and shall implement the procedures in the Project Development Plans to assure such compliance.
