Project Control. (1) Construction Manager shall construct the Work in strict accordance with the Contract Documents within the time required by the Schedule approved by Owner and as required by Owner’s Standard Uniform General and Supplementary General Conditions, and Division I Specifications. Construction Manager shall award and enter into, as a general contractor, all Subcontracts necessary and appropriate to provide all labor and materials for the construction of the Project. Construction Manager shall self-perform only General Conditions Work and other Work, which has been awarded to Construction Manager in accordance with the requirements of Texas Education Code section 51.782, and this Contract. Owner reserves the right to perform Work related to the Project and to award separate contracts for Work related to the Project. (2) Monitor the Work of the Subcontractors as required and coordinate such Work with the activities and responsibilities of the Project Team with a goal to attain completion of the Project at a cost not to exceed the Project Construction Budget and Guaranteed Maximum Price, and to attain Substantial Completion by the date set forth in Exhibit C herein when executed. (3) Attend Owner’s Project progress meetings scheduled by Owner no less often that once per month, and fully advise the Project Team at such meetings as to Project status. (4) Schedule, direct and attend regular meetings with other members of the Project Team during the construction of the Project to discuss jointly such matters as procedures, progress, problems and scheduling. Prior to each meeting, the Construction Manager shall prepare and distribute to the other Project Team members a written agenda for the meeting. Prepare and distribute at each Project Team meeting a memorandum setting forth the list of critical activities that require immediate action and the date(s) by when the activity must be completed, and record and distribute the minutes of each meeting. (5) As provided in Exhibit A, maintain a competent, full-time staff at the Project site to coordinate and provide general direction over the Work and progress of the Subcontractors on the Project. (6) As provided in Exhibit A, establish on-site organization of personnel and clearly defined lines of authority in order to effectuate the overall plans of the Project Team. At a minimum, Construction Manager’s site personnel shall include qualified staff as proposed in the approved Contractor’s General Conditions. (7) In consultation with Owner, establish procedures for coordination among the Project Team, Subcontractors, separate contractors, Design Consultants, and other consultants with respect to all aspects of the construction of the Project, and implement such procedures. (8) Expedite and coordinate delivery and installation of Owner-procured material and equipment. The Construction Manager shall coordinate efforts to include the Owner’s Project Architect in the preparation, development and review of the CM’s GMP Proposal which will include the qualifications, clarifications, assumptions, exclusions, value engineering and all other requirements identified within Attachment 1 to Exhibit C (Guidelines for the Preparation of the GMP). Following Owner approval of the GMP Proposal, the CM shall monitor the development of the Construction Documents to confirm that, when complete, the documents reflect the appropriate detail describing all qualifications, assumptions, exclusions and value engineering issues contained in the GMP Proposal. The Construction Manager and the Project Architect shall jointly provide a monthly status report stating the progress of the incorporation of the GMP qualifications, clarifications, assumptions, exclusions, value engineering and all other provisions, identified in Attachment 1 To Exhibit C, into the Construction Documents.” (9) Construction Manager shall supervise and direct the Work and shall be solely responsible for construction means, methods, techniques, sequences, and procedures for the Work. (10) In accordance with Owner’s Standard Uniform General and Supplementary Conditions, provide and pay for all labor, materials, equipment, tools, construction equipment and machinery, water, heat, utilities, transportation, and all other facilities and services necessary for the proper execution and completion of the Work in strict accordance with the requirements of the Contract Documents. (11) Obtain building permits and special permits for permanent improvements as required by law or the Contract Documents. Assist Owner or Design Consultant in obtaining all approvals required from authorities having jurisdiction over the Project. (12) Inspect the Work of Subcontractors to ensure conformance with the Contract Documents.

(2) Monitor Before proceeding with the Work for the Construction Phase, the Construction Manager shall review the Drawings and Specifications and any available geotechnical data reports and shall find them, in writing to the City Engineer, adequate to complete the Work within the Guaranteed Maximum Price and within the Contract Time. The Construction Manager shall notify the Design Consultant and Project Manager of any errors, omissions, or discrepancies in the Drawings and Specifications it discovers with respect to the existing conditions. Upon discovering a further defect in the Drawings or Specifications or other Contract Documents, the Construction Manager shall submit a written request within five (5) Business Days from discovery for an explanation or decision to the Design Consultant and the Project Manager. The Construction Manager shall use its best efforts to cooperate with the Project Manager and Design Consultant to resolve the discovered defects so as not to unnecessarily impede the progress of the Work. Should the defect be determined as Work that is reasonably inferable from the Contract Documents, the Construction Manager shall proceed with the Work and the Construction Manager shall be responsible for all resulting cost, including the cost of redoing or remedying the Work and time delays resulting therefrom. To the extent such costs result from concealed conditions that were not known or not reasonably inferable to Construction Manager having used best reasonable efforts to discover such concealed conditions, then Construction Manager shall not be responsible for such costs. Any claims for concealed or unknown conditions are required to comply with the requirements of Section 4.3.5 of the Document 00700-General Conditions.
(3) Fully monitor the Work of the Subcontractors as required and coordinate such Work with the activities and responsibilities of the Project Team with a goal to attain completion of the Project at all Phases and all Work for a cost not to exceed the Project Construction Budget and Guaranteed Maximum PricePrice for the Construction Phase and all Work, and to attain of attaining Substantial Completion by the date set forth in Exhibit C herein when executeddate(s) by which the Contract Documents require Construction Manager to achieve Substantial Completion for the Construction Phase and all Work.
(34) Attend OwnerCity’s Project progress meetings (these are separate from the meetings described in subsection (5), below) scheduled by Owner Project Manager (which will occur no less often that than once per monthweek), and fully advise the Project Team Team, to the Project Manager’s satisfaction, at such meetings as to Project status.
(45) Schedule, direct direct, and attend regular meetings with other members of the Project Team during the construction of the Project to discuss jointly such matters as procedures, progress, problems problems, and scheduling. Prior to each meeting, the Construction Manager shall prepare and distribute to the other Project Team members a written agenda for the meeting. Prepare and distribute at each Project Team meeting a memorandum setting forth the list of critical activities that which require immediate action and the date(s) by when the activity must be completed, and record and distribute the minutes of each meeting within five (5) Business Days of such meeting.

(1112) Obtain building permits and special permits for permanent improvements as required by law or the Contract Documents. Assist Owner City or Design Consultant in obtaining all approvals applicable permits and approvals, which they may be required to obtain from authorities having jurisdiction over the Project.
(1213) Inspect Construction Manager will coordinate activities of the Work of Subcontractors City’s independent testing laboratories to ensure conformance with the Contract Documents. The Construction Manager will rely on the test results of the City’s independent testing laboratories.
(14) All work performed shall conform to and comply with the FAA approved Construction Safety Phasing Plan (CSSP), if applicable.

In accordance with Owner’s Standard Uniform General and Supplementary Conditions, provide and pay for all labor, materials, equipment, tools, construction equipment and machinery, water, heat, utilities, transportation, and all other facilities and services necessary for the proper execution and completion of the Work in strict accordance with the requirements of the Contract Documents.
(11) 12. Obtain building permits and special permits for permanent improvements as required by law or the Contract Documents. Assist Owner or Design Consultant in obtaining all approvals required from authorities having jurisdiction over the Project.

Project Control. (1) Construction Manager shall construct the Work in strict accordance with the Contract Documents within the time required by the Schedule approved by Owner and as required by the Contract and the Owner’s Standard Uniform General and Supplementary General Conditions, and/or Supplemental Conditions and Division I Specifications. Construction Manager shall award and enter into, as a general contractor, all Subcontracts necessary and appropriate to provide all labor and materials for the construction of the Project. Construction Manager shall self-perform only General Conditions Work and other Work, Work which has been awarded to Construction Manager in accordance with the requirements of Texas Education Government Code section 51.782, 2267.255 and this Contract. Owner reserves the right to perform Work related to the Project and to award separate contracts for Work related to the Project. The Owner’s consent may be provided to the Construction Manager at the beginning of Part I Services and does not have to be requested on an item-by-item basis.
(2) Monitor the Work of the Subcontractors as required and coordinate such Work with the activities and responsibilities of the Project Team with a goal to attain completion of the Project at a cost not to exceed the Project Construction Budget and Guaranteed Maximum Price, and to attain Substantial Completion by the date set forth in Exhibit C “B” herein when executed.
(3) Attend all Owner’s Project progress meetings scheduled by Owner no less often that than once per month, and fully advise the Project Team at such meetings as to Project status.
(4) Schedule, direct and attend regular meetings with other members of the Project Team during the construction of the Project to discuss jointly such matters as procedures, progress, problems and scheduling. Prior to each meeting, the Construction Manager shall prepare and distribute to the other Project Team members a written agenda for the meeting. Prepare and distribute at each Project Team meeting a memorandum setting forth the list of critical activities that activities, which require immediate action and the date(s) by when the activity must be completed, and record and distribute the minutes of each meeting.
(5) As provided in Exhibit A, maintain Maintain a competent, full-time staff at the Project site to coordinate and provide general direction over the Work and progress of the Subcontractors on of the Project.
(6) As provided in Exhibit A, establish Establish on-site organization of personnel and clearly defined lines of authority in order to effectuate the overall plans of the Project Team. At a minimum, Construction Manager’s site personnel shall include qualified staff as proposed in the approved Contractor’s General Conditionsa project manager, project superintendent, project engineer, and appropriate administrative support personnel.
(7) In consultation with Owner, establish procedures for coordination among the Project Team, Subcontractors, separate contractors, Design Consultants, and other consultants with respect to all aspects of the construction of the Project, and implement such procedures.
(8) Expedite and coordinate delivery and installation of Owner-procured material and equipment. The Construction Manager shall coordinate efforts to include the Owner’s Project Architect in the preparation, development and review of the CM’s GMP Proposal which will include the qualifications, clarifications, assumptions, exclusions, value engineering and all other requirements identified within Attachment 1 to Exhibit C (Guidelines for the Preparation of the GMP). Following Owner approval of the GMP Proposal, the CM shall monitor the development of the Construction Documents to confirm that, when complete, the documents reflect the appropriate detail describing all qualifications, assumptions, exclusions and value engineering issues contained in the GMP Proposal. The Construction Manager and the Project Architect shall jointly provide a monthly status report stating the progress of the incorporation of the GMP qualifications, clarifications, assumptions, exclusions, value engineering and all other provisions, identified in Attachment 1 To Exhibit C, into the Construction Documents.”
(9) Construction Manager shall supervise and direct the Work and shall be solely responsible for construction means, methods, techniques, sequences, and procedures for the Work, subject to Section 3.3.1 of the Owner’s General Conditions.
(10) In accordance with Owner’s Standard Uniform General and Supplementary and/or Supplemental Conditions, provide and pay for all labor, materials, equipment, tools, construction equipment and machinery, water, heat, utilities, transportation, and all other facilities and services necessary for the proper execution and completion of the Work in strict accordance with the requirements of the Contract Documents.
(11) Obtain Assist Owner in securing building permits and special permits for permanent improvements as required by law or the Contract Documents. Assist Owner or Design Consultant in obtaining all approvals required from authorities having jurisdiction over the Project.
(12) Inspect the Work of Subcontractors to ensure conformance with the Contract Documents.
(13) Support HISD’s efforts to obtain LEED® points and/or certification in areas over which Construction Manager has control.
