Project Improvements. (a) The Project Improvements shall be constructed consistent with the Redevelopment Plan, this Agreement, the Governmental Approvals and all Applicable Laws. (b) The Project Improvements shall be utilized solely for the purposes more fully set forth in the Redevelopment Plan and this Agreement. (c) The Redeveloper shall provide for the timely development of the Project Improvements in conformance with the Project Schedule, and will cooperate with the Borough to avoid unreasonable interference with the operation of any existing Utilities. Redeveloper agrees to provide all performance and maintenance bonds and inspection fees as may be required by the Governmental Approvals. (d) Without limitation, all work on the Project Improvements shall be performed in a good and workmanlike manner, using, where specified, the materials called for under the Governmental Approvals being of such quality as may be specifically required by such Governmental Approvals. All construction shall be in accordance with the Uniform Construction Code, codified at N.J.A.C. 52:3-1 et seq. (the “UCC”).

(b) The Project Vertical Improvements shall be utilized solely for the purposes more fully set forth in the Redevelopment Plan and this Agreement.
(c) The Redeveloper shall provide for the timely development of the Project Improvements in conformance with the Project Schedule, and will cooperate with the Borough to avoid unreasonable interference with the operation of any existing Utilities.
