Common use of Project Progress Clause in Contracts

Project Progress. You will: 11.1 no later than the Project Start Date begin and thereafter diligently carry out the Project in accordance with the terms of this Agreement; 11.2 promptly and efficiently complete the Project and achieve the Outputs and Results in accordance with the Agreed Proposal and the Timetable and all other requirements for delivery of the Project. 11.3 comply with all relevant legislation, Consents, Accreditations and any requirements of any local or other authorities affecting the Project in carrying out the Project; 11.4 notify us in writing immediately if you become aware that the Outputs and Results for the then current Financial Year of the Project are likely to exceed or are likely to be less than the relevant agreed number of Outputs and Results as set out in the Monthly Progress Return; 11.5 notify us immediately if you become aware of any issues that may affect delivery of the Project in accordance with the Agreed Proposal and/or the Timetable and/or any other requirements for the delivery of the Project or that may require any material changes to be made in relation to the Project; 11.6 attend or host periodic review meetings (at a frequency determined by us but in any event no less than twice per Financial Year) to discuss: progress which we shall assess by reference to your claims, the information in the Outputs Block on OPS, the Participant and/or Beneficiary Organisation Data Forms, information and data collected during Project Monitoring; and any issue(s) impacting upon Project delivery; 11.7 co-operate fully with and provide all information and assistance as required by us for the purpose of review of the Project, the Grant, and/or this Agreement; 11.8 comply fully with all our requests in relation to any capacity building strategies that may be notified to you by us (including in relation to project succession and exit strategies). You will participate in and comply with all programmes introduced by us in relation to such capacity building strategies. You will further ensure that you introduce a process of continual review of your organisational capacity to deliver the Project and that appropriate steps are taken by you to address any issues that may arise or are identified in relation to such programmes and/or in relation to the implementation of such capacity building strategies; 11.9 without prejudice to our rights under clause 14 (Audit), comply fully with all requests in relation to our evaluation strategies and/or requirements, and with all programmes introduced by us in relation to such evaluation strategies and/or requirements from time to time. 11.10 prior to enrolling a participant on any Project Activities assess and confirm that such participant is eligible to participate in the Project Activities. You will further ensure that you introduce a process of continual review of your organisational capacity to deliver the Project and that appropriate steps are taken by you to address any issues that may arise or are identified in relation to such programmes and/or in relation to the implementation of such capacity building strategies; 11.9 without prejudice to our rights under clause 14 (Audit), comply fully with all requests in relation to our evaluation strategies and/or requirements, and with all programmes introduced by us in relation to such evaluation strategies and/or requirements from time to time. 11.10 prior to enrolling a participant on any Project Activities assess and confirm that such participant is eligible to participate in the Project Activities. The assessment in this regard will be carried out in accordance with the guidance contained in the ESF Evidence Handbook and in accordance with the ESF requirements published on ▇▇▇▇://▇▇▇.▇▇▇.▇▇/guidance▇.▇▇/esf/england-2014-to-2020-european-structural-and- investment-funds resources/ as varied from time to time; 11.11 for each new participant who is reported as a starter on the Project, complete and hold on record: 11.11.1 a participant enrolment form; and 11.11.2 a bespoke training plan; (a sample of each of which is provided in the Delivery Partner ESF Handbook), which record clearly, in agreement with the participant, the overall objectives of the participant’s involvement on the Project; 11.12 provide all necessary support to participants for a period of up to twelve months after the completion of their programme of training and ensure that we are updated with the most accurate information regarding progression Results on the Monthly Progress Return; 11.13 carry out regular reviews of a participant’s progress towards their overall objectives (as set out in their bespoke training plan and bespoke engagement plan, as defined in the Delivery Partner ESF Handbook) at least every four weeks, documenting results of the review and agreeing the review as a true record by at least the participant and their tutor; 11.14 Not used.

The assessment in this regard will be carried out in accordance with the guidance contained in the Evidence Handbook and in accordance with the ESF requirements published on ▇▇▇▇://▇▇▇.▇▇▇.▇▇/guidance▇.▇▇/esf/england-2014-to-2020-european-structural-and- investment-funds resources/ as varied from time to time; 11.11 for each new participant who is reported as a starter on the Project, complete and hold on record: 11.11.1 a participant enrolment form; and 11.11.2 a bespoke training plan; (a sample of each of which is provided in the Delivery Handbook set out at Schedule 7 to this Agreement (as amended from time to time), which record clearly, in agreement with the participant, the overall objectives of the participant’s involvement on the Project; 11.12 provide all necessary support to participants for a period of up to six months after the completion of their programme of training and ensure that we are updated with the most accurate information regarding progression Results on the Monthly Progress Return; 11.13 carry out regular reviews of a participant’s progress towards their overall objectives (as set out in their bespoke training plan, as defined in the Delivery Handbook) at least every four weeks, documenting results of the review and agreeing the review as a true record by at least the participant and their tutor; 11.14 during the lifetime of the Project, or when the Project is approaching the Project End Date, where the Project has been unable to progress a participant into an appropriate Result, the Grantee should ensure that an exit strategy exists for each participant which clearly identifies their preferred or most suitable route forward, and confirms any referral destination following the participants exit from the Project. 11.15 except for projects funded under ESF Investment Priority 2.2, provide a qualitative and quantitative periodic assessment of progress towards the achievement of the objectives of this project by complying with the requirements in relation to the Employability Performance Rating (EPR) as set out in the Delivery Handbook. 11.16 We shall monitor your compliance with the requirements of this clause 11 any failure to comply with such requirements may be treated by us as a fundamental breach of this Agreement for the purposes of clause 23 (Reduction, Suspension, Withholding and Recovery of Grants) and clause 30 (Termination/Events of Default).

You will participate in and comply with all programmes introduced by us in relation to such capacity building strategies. You will further ensure that you introduce a process of continual review of your organisational capacity to deliver the Project and that appropriate steps are taken by you to address any issues that may arise or are identified in relation to such programmes and/or in relation to the implementation of such capacity building strategies; 11.9 without prejudice to our rights under clause 14 (Audit), comply fully with all requests in relation to our evaluation strategies and/or requirements, and with all programmes introduced by us in relation to such evaluation strategies and/or requirements from time to time. 11.10 prior to enrolling a beneficiary organisation or participant on any Project Activities assess and confirm that such participant is eligible to participate in the Project Activities. Project Progress. You will: 11.1 no later than the Project Start Date begin and thereafter diligently carry out the Project in accordance with the terms of this Agreement; 11.2 promptly and efficiently complete the Project and achieve the Outputs and Results Outcomes in accordance with the Agreed Proposal and the Timetable and all other requirements for delivery of the Project. 11.3 comply with all relevant legislation, Consents, Accreditations and any requirements of any local or other authorities affecting the Project in carrying out the Project; 11.4 notify us in writing immediately if you become aware that the Outputs and Results Outcomes for the then current Financial Year of the Project are likely to exceed or are likely to be less than the relevant agreed number of Outputs and Results Outcomes as set out in the Monthly Progress Outputs and Outcomes Values Return; 11.5 notify us immediately if you become aware of any issues that may affect delivery of the Project in accordance with the Agreed Proposal and/or the Timetable and/or any other requirements for the delivery of the Project or that may require any material changes to be made in relation to the Project; 11.6 attend or host periodic review meetings to discuss progress (at a frequency determined by us but in any event no less than twice per Financial YearYear but more frequently if required by us) to discuss: progress which we shall assess by reference to your claims, the information in the Outputs Block on OPS, the Participant and/or Beneficiary Organisation Data Forms, information and data collected during Project Monitoring; and any issue(s) impacting upon Project deliveryMonitoring Checklist; 11.7 co-operate fully with and provide all information and assistance as required by us for the purpose of review of the Project, the Grant, and/or this Agreement; 11.8 comply fully with all our requests in relation to any capacity building strategies that may be notified to you by us (including in relation to project succession and exit strategies). You will participate in in, and comply with all programmes introduced by us in relation to such capacity building strategies. The assessment in this regard will be carried out in accordance with the guidance contained in the ESF Outputs and Outcomes Definitions and Evidence Requirements Handbook and in accordance with the ESF requirements published on ▇▇▇▇://▇▇▇.▇▇▇.▇▇/guidance▇.▇▇/esf/england-2014-to-2020-european-structural-and- investment-funds resources/ as varied from time to time; 11.11 for each new participant who is reported as a starter on the Project, complete and hold on record: 11.11.1 a participant enrolment form; and 11.11.2 a bespoke training plan; (a sample of each of which is provided in the Delivery Partner ESF Handbook), which record clearly, in agreement with the participant, the overall objectives of the participant’s involvement on the Project; 11.12 provide all necessary support to participants for a period of up to twelve months after the completion of their programme of training and ensure that we are updated with the most accurate information regarding progression outcomes on the Outputs and Outcomes Value Return; 11.13 carry out regular reviews of a participant’s progress towards their overall objectives (as set out in their bespoke training plan and bespoke engagement plan, as defined in the Delivery Partner ESF Handbook) at least every four weeks, documenting results of the review and agreeing the review as a true record by at least the participant and their tutor; 11.14 where the Outputs and Outcomes to be delivered under this Agreement involve the delivery of Skills for Life training (including the delivery of Skills for Life teacher training) collaborate fully and co-operate with the Pan-London Strategic Unit for Skills for Life Professional Development or any successor body to that body ("Strategic Unit") in the provision of summary data on teacher training; 11.15 ensure that all Skills for Life teacher training and teacher education and professional development courses provided by you will work towards any quality standards set by the Strategic Unit, and any national standards set by the Further Education National Training Organisation or any successor body to that body. 11.16 We shall monitor your compliance with the requirements of this clause 11 any failure to comply with such requirements may be treated by us as a fundamental breach of this Agreement for the purposes of clause 23 (Reduction, Suspension, Withholding and Recovery of Grants) and clause 30 (Termination/Events of Default).
