Common use of Proportionate Leave on Termination Clause in Contracts

Proportionate Leave on Termination. Where an employee has given one week or more continuous service, inclusive of any day off as prescribed by clause 21 - Hours of work (excluding overtime), and he/she either leaves his/her employment or his/her employment is terminated by the employer he/she shall be paid one-twelfth of an ordinary week’s wages in respect of each completed week of continuous service with his/her current employer for which leave has not been granted or paid for in accordance with this Agreement.

Where an employee has given one week five (5) working days or more continuous serviceservice (other than a casual employee), inclusive of any agreed day off as prescribed by clause 21 - Hours of work (excluding overtime)off, and he/she either leaves his/her employment or his/her employment is terminated by the his/her employer he/she shall be paid one-twelfth of an ordinary week’s wages any untaken annual leave as defined in respect of each completed week of continuous service with his/her current employer for which leave has not been granted or paid for in accordance with this Agreementclause 14.1.

Proportionate Leave on Termination. Where If after one month’s continuous service an employee has given one week or more continuous service, inclusive of any day off as prescribed by clause 21 - Hours of work (excluding overtime), and he/she either leaves his/her the employment or his/her employment is terminated by the employer he/she employer, the employee shall be paid one-twelfth 2.923 hours at the ordinary rate of an ordinary week’s wages wage applicable in respect of accordance with 7.1.8 for each completed week of continuous service with his/her current employer for in respect of which annual leave has not been granted or paid for in accordance with under this Agreementclause.

Where an An employee has given one week or more continuous service, inclusive on weekly hiring who leaves the employment of any day off as prescribed by clause 21 - Hours of work (excluding overtime), and he/she either leaves his/her employment the company or his/her employment is terminated by the employer he/she company for any reason, shall be paid oneon a pro-twelfth rata basis for 12 hours for each completed four week period of an 36 ordinary week’s wages hours worked and in respect of each completed week of continuous service with his/her current employer for which leave has had not been granted or paid for under this clause at the appropriate rate of wage calculated in accordance with this Agreementclause 4.2.

Proportionate Leave on Termination. Where an employee has given If, after one week or more continuous serviceweek's Continuous Service in any qualifying twelve month period, inclusive of any day off as prescribed by clause 21 - Hours of work (excluding overtime), and he/she either leaves his/her employment or his/her employment is terminated by the employer he/she shall Company or employee for any reason, the employee will be paid one-twelfth at the applicable rate of an ordinary week’s wages wage for 3.654 hours in respect of each completed week of continuous service with his/her current employer for which leave has not been granted or paid for in accordance with this AgreementContinuous Service.

Where (a) If after one week's continuous Service in any qualifying 12 monthly period, an employee has given one week or more continuous service, inclusive of any day off as prescribed by clause 21 - Hours of work (excluding overtime), and he/she either lawfully leaves his/her their employment or his/her their employment is terminated by the employer he/she through no fault of the employee, the employee shall be paid one-twelfth at the appropriate rate of an ordinary week’s wages wage prescribed in respect of clause 5.4 (Employees Wages) for 2.923 hours for each completed week of continuous service with his/her current employer for which leave has not been granted or paid for in accordance with this AgreementService.
