Proposed Categorization and Deadlines. In this section we present, provision by provision, a short summary of the main objectives of the provision (when necessary resorting to the WTO Needs Assessment Guide to facilitate interpretation), as well as a description of its current situation. Where there are issues of interpretation, these are listed, the implications of different interpretations are indicated, and the decision taken is indicated with a justification. Where there are barriers or gaps to compliance, these are identified – i.e., it is identified what should change so that the country can comply – and then, on the basis of the elements referred to above, a Category and a deadline for implementation are proposed and, where possible, an effort is also made to define the next steps. This information and the decisions on categorization and deadlines were validated during the two technical meetings in March 2016, and validation meetings with private sector representatives on the 19th and 26th of April 2016, but will still be object of a higher-level discussion and validation. Once validated and agreed at that level, it should serve as the basis for the national ratification process, for the notification to the WTO, for the definition of actions plans to guide the Government in the implementation of Category B articles, and for the definition of detailed Terms of Reference for the Category C articles. Of a total of 41 provisions1, 24 were considered of Category A, 7 of Category B, and 10 of Category C. Of the Category B provisions, 6 can be implemented within 1 year, and one within 2 years. Of the Category C provisions, 1 can be implemented within 1 year, 2 will need 3 years, and 7 more complex ones will need 5 years for their implementation. 1 A few similar provisions were combined, for example those of Article 11 on transit.   • Minimum Site Requirements for TIPS Sales (when applicable to TIPS Sale). Cleanup: When performing work on site at a TIPS Member’s property, Vendor shall clean up and remove all debris and rubbish resulting from their work as required or directed by the TIPS Member or as agreed by the parties. Upon completion of work, the premises shall be left in good repair and an orderly, neat, clean and unobstructed condition. Preparation: Vendor shall not begin a project for which a TIPS Member has not prepared the site, unless Vendor does the preparation work at no cost, or until TIPS Member includes the cost of site preparation in the TIPS Sale Site preparation includes, but is not limited to: moving furniture, installing wiring for networks or power, and similar pre‐installation requirements. Registered Sex Offender Restrictions: For work to be performed at schools, Vendor agrees that no employee of Vendor or a subcontractor who has been adjudicated to be a registered sex offender will perform work at any time when students are, or reasonably expected to be, present unless otherwise agreed by the TIPS Member. Vendor agrees that a violation of this condition shall be considered a material breach and may result in the cancellation of the TIPS Sale at the TIPS Member’s discretion. Vendor must identify any additional costs associated with compliance of this term. If no costs are specified, compliance with this term will be provided at no additional charge. Safety Measures: Vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage. Smoking: Persons working under Agreement shall adhere to the TIPS Member’s or local smoking statutes, codes, ordinances, and policies.

  • CERTIFICATION REGARDING DRUG-FREE WORKPLACE REQUIREMENTS 1. The Contractor certifies that it will provide a drug-free workplace by: a. Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the Contractor’s workplace and specifying the actions that will be taken against employees for violation of such prohibition;

  • Regulation AB Compliance; Intent of Parties; Reasonableness The parties hereto acknowledge that interpretations of the requirements of Regulation AB may change over time, whether due to interpretive guidance provided by the Commission or its staff, consensus among participants in the asset-backed securities markets, advice of counsel, or otherwise, and agree to comply with requests made by the Depositor or the Master Servicer in good faith for delivery of information under these provisions on the basis of evolving interpretations of Regulation AB.   • Presentation of Potential Target Businesses The Company shall cause each of the Initial Shareholders to agree that, in order to minimize potential conflicts of interest which may arise from multiple affiliations, the Initial Shareholders will present to the Company for its consideration, prior to presentation to any other person or company, any suitable opportunity to acquire an operating business, until the earlier of the consummation by the Company of a Business Combination or the liquidation of the Company, subject to any pre-existing fiduciary obligations the Initial Shareholders might have.

  • Geographic Area and Sector Specific Allowances, Conditions and Exceptions The following allowances and conditions shall apply where relevant.
