Common use of PROTECTED AWARD CONDITIONS Clause in Contracts

PROTECTED AWARD CONDITIONS. a) Were it not for the operation of this workplace agreement, the following awards would have applied to the employees covered under the agreement: a. the Metal, Engineering and Associated Industries Award 1998: i. Part I; ii. Part IV – Long Service Leave; and b. The Metal, Engineering and Associated Industries (Superannuation) Award 2000. b) Under s.354 of the Workplace Relations Act 1996 the provisions of the awards set out in a) which deal with the following matters are protected award conditions: - Rest breaks; - Incentive based payments and loadings; - Annual leave loadings; - Days declared are public holidays under a State or Territory law (including substitute days) and entitlements to payment on those days: - Monetary allowances; - Loadings for working overtime or shift work; - Penalty rates; and - Outworker conditions. c) The protected award conditions are taken to be included in this workplace agreement and have effect in relation to the employment of persons covered by this agreement.

The (ii) the Metal, Engineering and Associated Industries (Superannuation) Award 2000. b) Under s.354 of the Workplace Relations Act 1996 the provisions of the awards set out in a) which deal with the following matters are protected award conditions: - Rest breaks; - Incentive based payments and loadings; - Annual leave loadings; - Days declared are as public holidays under a State or Territory law (including substitute days) and entitlements to payment on those days: - Monetary allowances; - Loadings for working overtime or shift work; - Penalty rates; and - Outworker conditions. c) The protected award conditions are taken to be included in this workplace agreement excluded and have no effect in relation to the employment of persons covered by this agreement.
