Common use of Provision of Delivery Services Clause in Contracts

Provision of Delivery Services. (a) You can go online in the Driver App if, when, where, and for however long, you choose. (b) You may be sent Requests for the different delivery options that you are signed up for. If you are sent a Request you will be provided with information about the Request to allow you to decide whether to accept and provide the Delivery Services. (c) You can accept or reject Requests at your discretion. (d) You can cancel accepted Requests before the collection of Items at your discretion. (e) You can also cancel accepted Requests after the collection of Items at your discretion. If this happens for certain deliveries, including Regulated Items, you may be asked to return the Item to the place where the Item was collected. (f) It is your responsibility (and not Uber or UTI’s) to: (i) determine an effective, efficient, and safe manner to provide Delivery Services, including a reasonable route to be taken to fulfil Requests, (ii) provide all necessary equipment, tools, and other materials necessary to provide Delivery Services, at your own cost, (iii) obtain, operate, and maintain your Transportation Method, (iv) pick up Items from relevant locations to fulfil Requests, and (v) communicate with Merchants and Delivery Recipients as appropriate regarding logistics or instructions about your Delivery Services. (g) You acknowledge that: (i) Uber is not responsible or liable for acts or omissions of any Merchant or Delivery Recipient in relation to you, your Delivery Services, or your Transportation Method, (ii) you are responsible for taking reasonable precautions to protect yourself and third parties in relation to the acts or omissions of a Merchant, a Delivery Recipient, or other third parties, (iii) you are responsible for liabilities to Merchants, Delivery Recipients, or other third parties that directly arise from your acts or omissions or your Transportation Method, and (iv) you carry out your own trade and business when providing Delivery Services using the Driver App. (h) If a Merchant, Delivery Recipient, or other user of the Uber Eats Platform breaches the Community Guidelines, you can report the breach to Uber or its Affiliates, and Uber or its Affiliates may investigate and take appropriate action which may include removing the reported party’s access to the Uber Eats Platform. (i) You can appoint a delegate to provide Delivery Services on your behalf for a particular Request, provided the delegate is a Delivery Provider who also has their own Driver Account and you agree to any applicable Addendum. (j) While there are generally no consequences for rejecting or cancelling Requests, you will not receive a Delivery Fee for Requests that you reject or cancel. Your status tier in loyalty or rewards programs, or access to loyalty-program or rewards-program benefits, may be impacted by your rates of accepting or cancelling Requests. Repeat cancellations may also trigger fraud-monitoring processes.

Provision of Delivery Services. (a) You can go online in log into the Uber Driver App if, when, where, and for however how long, you choose. (b) You may be sent Requests for the different delivery options products that you are signed up for. If you are sent a Request you will be provided with key information about the a Request to allow you to decide whether to accept and provide the Delivery Services, which may include: (i) the name and location of the place where items are to be collected; (ii) the delivery product to which the Request relates; (iii) the approximate location of the Delivery Recipient; and (iv) a minimum Delivery Fee (described in section 7.1). (c) You can accept or reject may opt in to, and then opt out of, receiving Requests for available delivery products at any time at your sole discretion. (d) You can may accept or reject Requests at your absolute discretion and without consequence. (e) You may cancel accepted Requests before the collection of Items items at your discretionabsolute discretion and without consequence. (ef) You can may also cancel accepted Requests after the collection of Items items at your absolute discretion. If this happens While there are generally no consequences for this, repeated cancelations after items have been collected may trigger fraud and/or quality management processes. In addition, for certain deliveries, including Regulated Items, deliveries you may be asked requested to return the Item item to the place where the Item item was collected. (g) You will not be paid a Delivery Fee for cancelled Requests, unless otherwise agreed with ▇▇▇▇▇▇▇ NZ. (h) You must not accept a Request where doing so would place you in breach of your right to work, or in breach of a condition on a New Zealand visa that you hold. Where ▇▇▇▇▇▇▇ NZ is aware that you have accepted one or more Requests in breach of a condition on your right to work in New Zealand, ▇▇▇▇▇▇▇ NZ may take any action reasonably necessary to ensure that you do not continue to be sent Requests. Uber may restrict or deactivate your access to the Uber Driver App. (i) If you accept a Request you must provide Delivery Services in accordance with this Agreement, unless you cancel the Request in accordance with section 5.1(e) or (f). (j) It is your responsibility (and not Uber or UTI’s) to: (i) determine an the most effective, efficient, efficient and safe manner to provide Delivery Services, including a reasonable the route to be taken to fulfil Requests,; (ii) provide all necessary equipment, tools, tools and other materials necessary to provide Delivery Services, at your own cost,; and (iii) obtain, operate, and maintain your Transportation Method, (iv) pick up Items items from relevant locations locations, to fulfil Requests, and (v) communicate with Merchants and Delivery Recipients as appropriate regarding logistics or instructions about your Delivery Services. (l) When performing Delivery Services, you do so as a person conducting a business or undertaking, which means you may have obligations under safety laws. You must promptly notify ▇▇▇▇▇▇▇ NZ of any accidents that occur while providing Delivery Services and cooperate and provide information requested by ▇▇▇▇▇▇▇ NZ in relation to such accidents. (m) You acknowledge that: (i) Uber ▇▇▇▇▇▇▇ NZ is not responsible or liable for acts or omissions of any Merchant Customer or Delivery Recipient in relation to you, your the Delivery Services, Services or your Transportation Method,; (ii) you are responsible for taking reasonable precautions to protect yourself and third parties in relation to the acts or omissions of a MerchantCustomer, a Delivery Recipient, Recipient or other third parties,; (iii) you are responsible for liabilities to MerchantsCustomers, Delivery Recipients, Recipients or other third parties that directly arise from your acts or omissions or your Transportation Method, ; and (iv) you carry out your own trade and business when providing Delivery Services using the Uber Driver App. (h) If a Merchant, Delivery Recipient, or other user of the Uber Eats Platform breaches the Community Guidelines, you can report the breach to Uber or its Affiliates, and Uber or its Affiliates may investigate and take appropriate action which may include removing the reported party’s access to the Uber Eats Platform.
