Provision of development contribution. (a) The Developer is to make Development Contributions to the Council in accordance with Schedule 1 of this Agreement and otherwise to the satisfaction of the Council. (b) The Council is to apply each Development Contribution made by the Developer towards the Public Purpose for which it is made or in accordance with clause (c). (c) The Council may apply a Development Contribution toward a public purpose other than the Public Purpose specified in this Agreement if the Council considers that the public interest would be better served by applying the Development Contribution towards that other purpose.

10.1 The Developer is to make the Development Contributions Contribution to the Council in accordance with Schedule 1 and any other provision of this Agreement and otherwise Deed relating to the satisfaction making of the CouncilDevelopment Contribution.
(b) 10.2 The Council is to apply each Development Contribution made by the Developer under this Deed towards the Public Purpose for which it is made or and otherwise in accordance with clause (c)this Deed.
(c) The 10.3 Prior to the end of each financial year, Council may apply a must meet with the Developer to explain how the Development Contribution toward a public purpose other than Contributions were utilised by Council over the previous financial year and how such activities align with the Public Purpose specified in this Agreement if the Council considers that the public interest would be better served by applying the Development Contribution towards that other purposefor which it was made.
