Common use of Provision of Train Consist Data Clause in Contracts

Provision of Train Consist Data. Without prejudice to clause 6.4.1, the Train Operator shall: provide to the CVL IM such Train Consist Data as shall be necessary to enable the CVL IM to calculate the amount of Track Charges; and procure that such data is true and accurate in all respects. Track Charges and other payments Schedule 7 shall have effect. Liability In relation to any breach of this contract: the Innocent Party shall be entitled to apply under clause 13 for a Performance Order against the party in breach; and if a Performance Order is made, the party against whom it has been made shall comply with it.
