Common use of Provisional Remedies Clause in Contracts

Provisional Remedies. No Party shall be precluded from initiating a proceeding in the jurisdiction provided for in Section 8.4 for the purpose of obtaining any emergency or provisional remedy to protect its rights that may be necessary and that is not otherwise available under this Agreement, including temporary and preliminary injunctive relief, restraining orders, and the appointment of a receiver or manager in connection with the collection and retention of rates and charges, or the issuance of a writ of mandamus to compel the performance of duties required by law.

Provisional Remedies. No Party shall be precluded from initiating a proceeding in the a court of competent jurisdiction provided for in Section 8.4 for the purpose of obtaining any emergency or provisional remedy to protect its rights that may be necessary and that is not otherwise available under this Agreement, including temporary and preliminary injunctive relief, restraining orders, and the appointment of a receiver or manager in connection with the collection and retention of rates and charges, or the issuance of a writ of mandamus to compel the performance of duties required by law.
