Common use of Provisioning Clause in Contracts

Provisioning. 2.4.1 BellSouth shall provision services during its regular working hours. To the extent OneTone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneTone, BellSouth will not assess OneTone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneCredit Loans, BellSouth will not assess OneTone Credit Loans additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Credit Loans (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Credit Loans for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneEsodus, BellSouth will not assess OneTone Esodus additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Esodus (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Esodus for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneVMT, BellSouth will not assess OneTone VMT additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone VMT (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone VMT for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneTelecable, BellSouth will not assess OneTone Telecable additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Telecable (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone bill Telecable for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇FCC No. ▇ ▇▇▇▇▇▇1 Tariff, ▇▇▇▇▇▇▇ Section 13.3.1.

BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇FCC No. ▇ ▇▇▇▇▇▇1 Tariff, ▇▇▇▇▇▇▇ Section 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneNetwork PTS, BellSouth will not assess OneTone Network PTS additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Network PTS (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Network PTS for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneAllSouth Phone, BellSouth will not assess OneTone AllSouth Phone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone AllSouth Phone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone bill AllSouth Phone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇FCC No. ▇ ▇▇▇▇▇▇1 Tariff, ▇▇▇▇▇▇▇ Section 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneExcel PCHP, BellSouth will not assess OneTone Excel PCHP additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Excel PCHP (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Excel PCHP for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneEZ Communications, BellSouth will not assess OneTone EZ Communications additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone EZ Communications (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone EZ Communications for each additional dispatch required to provision the circuit due Version: 4Q05 Resale Standalone Agreement 02/27/06 to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneTelephone One, BellSouth will not assess OneTone Telephone One additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Telephone One (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Telephone One for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the Version: 4Q05 Resale Standalone Agreement 02/27/06 applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneU-Dial, BellSouth will not assess OneTone U-Dial additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone U-Dial (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone bill U-Dial for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇FCC No. ▇ ▇▇▇▇▇▇1 Tariff, ▇▇▇▇▇▇▇ Section 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneTitle Pawn, BellSouth will not assess OneTone Title Pawn additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Title Pawn (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Title Pawn for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneQuantumShift, BellSouth will not assess OneTone QuantumShift additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone QuantumShift (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone QuantumShift for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the Version: 4Q05 Resale Standalone Agreement 02/27/06 applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneTonePayless Telephone, BellSouth will not assess OneTone Payless Telephone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Payless Telephone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Payless Telephone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

To the extent OneTone Tallahassee Telephone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services State E Tariff, Section E13.213.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneTallahassee Telephone, BellSouth will not assess OneTone Tallahassee Telephone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 2.4.1 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone Tallahassee Telephone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Tallahassee Telephone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.113.3.1 (E).

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneM.T.G., BellSouth will not assess OneTone M.T.G. additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone M.T.G. (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone M.T.G. for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneGo-Tel, BellSouth will not assess OneTone Go-Tel additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone Go-Tel (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone Go-Tel for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s ▇▇▇ ▇▇. ▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇ 13.3.1.

Provisioning. 2.4.1 BellSouth shall provision services during its regular working hours. To the extent OneTone BudgeTel requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneToneBudgeTel, BellSouth will not assess OneTone BudgeTel additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End Usercustomer’s location more than once due to incorrect or incomplete information provided by OneTone BudgeTel (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will ▇▇▇▇ OneTone BudgeTel for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided.
