Common use of Provisions Binding on Successors Clause in Contracts

Provisions Binding on Successors. All the covenants, stipulations, promises and agreements in this Supplemental Indenture No. 3 contained by or on behalf of the Owner Trustee shall bind its successors and assigns, whether so expressed or not.Concerning the Owner Trustee. Wachovia Bank, National Association and ▇▇▇▇▇▇▇▇ ▇. ▇▇▇▇▇▇▇ are entering into this Supplemental Indenture No. 3 solely as Owner Trustee under the Trust Agreement and not in their individual capacities. Anything herein to the contrary notwithstanding, all and each of the agreements herein made on the part of the Owner Trustee are made and intended not as personal agreements of Wachovia Bank, National Association and ▇▇▇▇▇▇▇▇ ▇. ▇▇▇▇▇▇▇ but are made and intended for the purpose of binding only the Trust Estate.
