The "Public, Educational and Governmental Access" clause establishes the rights and obligations related to providing access to cable channels or other communication platforms for public, educational, and governmental use. PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS. The Access Corporation, as designated by the Issuing Authority, shall continue to be responsible for the provision of Public, Educational and Governmental ("PEG") Access Programming to Subscribers, pursuant to the provisions of this Article 6 herein.
PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS. LOCAL ORIGINATION FACILITIES AND SUPPORT
PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS. 17.1 Franchisee shall comply with applicable Federal and State law, rules, and regulations pertaining to non-commercial public, educational, and governmental (PEG) access to the System.
17.2 In order to ensure availability of public, educational and government programming, Franchisee shall provide to Municipality up to one (1) dedicated Public Access Channel, up to one (l) dedicated Educational Access Channel, and up to one (l) dedicated Government Access Channel (collectively, PEG Channels).
17.2.1 If a PEG Channel is not being utilized by the Municipality, Franchisee may utilize such PEG Channel, in its sole discretion, until such time as the Municipality elects to utilize the PEG Channel for its intended purpose. In the event that the Municipality determines to use PEG capacity, the Municipality shall provide Franchisee with prior written notice of such request in accordance with NYPSC rules and regulations.
17.3 Franchisee shall provide the Municipality and the residents of the Municipality with equitable access to all non-commercial PEG access services provided by Franchisee as part of its PEG access policies, rules, and procedures. Should Franchisee’s said policies, rules, and procedures be inconsistent with the standards established in Section 895.4 of the rules of the NYSPSC pertaining to non-commercial governmental, educational or public access, such rules shall govern.
17.4 All PEG channels provided by Franchisee may be offered in any format using any transmission method.
17.5 Franchisee shall continue to maintain an insertion point at Town Hall, which shall include a fiber-optic transmitter, for the purpose of permitting the Municipality to originate non- commercial government/education access programming on the lowest digitally transmitted service tier on System from such location.
17.6 In consideration of the grant of the rights in this Agreement for the term described herein, and subject to Sections 17.6.1 through 17.6.3 below, Franchisee shall tender to Municipality, for the support of PEG access capital needs, a total of fifty thousand dollars ($50,000.00) (the “▇▇▇ ▇▇▇▇▇”) payable in two (2) installments as follows:

PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS. The Grantee hereby agrees to provide at least three channels, one each for public, educational and governmental cablecasting pursuant to Ordinance Section 33 (c) (1-3). Each channel shall be at least 6 MHz NTSC analog or digital equivalent, be carried on the basic service, and be available to the entire subscriber system serving the Village. 17.4 At any time during the Term of the Franchise, and upon prior written notice to the Franchisee, the Municipality may designate the Village Hall, located at ▇▇ ▇▇▇▇▇ ▇. ▇▇▇▇▇▇ Way, Hempstead, New York 11 550, as the Municipality's "PEG Access Origination Site." Upon such designation, and subject to the successful completion ofall required site preparation work by the Municipality and provision of access to Franchisee for equipment installation, Franchisee shall, without charge to the Municipality, provide an upstream PEG Channel transmission connection between its video channel aggregation point and said PEG Access Origination Site in order to permit the government/educational access signal to be correctly routed from the PEG Access Origination Site to the government/educational access channel for distribution to Subscribers. The PEG Access Origination Site shall be operable within one hundred eighty (180) days of the Franchisee receiving from the Municipality the written notice described in this Section 17.4.
17.5 Franchisee specifically reserves the right to make or change channel assignments in its sole discretion upon notice to the Municipality
17.6 To the extent permitted by and consistent with applicable law, Franchisee may, in its sole discretion, pass through to subscribers the costs of support for PEG access provided in this Agreement.
PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS. 16.1 The Company will comply with Part 895.4 of the PSC Rules.
PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS. Use of a channel position for public, educational and governmental ("PEG") access shall be provided on the most basic tier of service offered by Franchisee in accordance with the Cable Act, Section 611, and as further set forth below. "Channel position" means a number designation on the Franchisee's channel lineup regardless of the transmission format (analog or digital). Franchisee does not relinquish its ownership of or ultimate right of control over a channel by designating it for PEG use. A PEG access user - whether an individual, educational or governmental user - acquires no property or other interest by virtue of the use of a channel position so designated. Franchisee shall not exercise editorial control over any public, educational, or governmental use of a channel position, except Franchisee may refuse to transmit any public access program or portion of a public access program that contains obscenity, indecency, or nudity. The Franchising Authority shall be responsible for developing, implementing, interpreting and enforcing rules for PEG Access Channel use.
(i) Upon written request, the Grantee/Franchisee shall make available for use by the Town . one
(1) PEG Access Channel for PEG Access purposes, which shall be used to transmit non- commercial PEG Access Programming to Subscribers, at no cost to the Town and shall be subject to the control and management of the Town and subject to the terms herein.
(ii) In order that the Town and/or its designee(s) can cablecast its PEG Access Programming over the Subscriber Network/Cable System, all PEG Access Programming shall be modulated by the Town and/or its designee(s) from its Origination Location (at the Myersville Town Hall located at ▇▇▇ ▇▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇▇, ▇▇ ▇▇▇▇▇) to the Cable System Headend or ▇▇▇▇▇▇▇ without charge, to the Town and/or its designee(s) for their use.
PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS. Section 6.1--- PEG ACCESS CHANNELS
A. Prior to Cable System Upgrade
(a) Upon the Effective Date of this Renewal License, the Licensee shall continue to make available two (2) Downstream Channel for ▇▇▇▇▇▇▇▇ ▇▇▇ Access, as follows:
(i) One (1) Downstream Channel for Public Access/Community Programming (herein a f t e r referred to as “Public Access Progra mming” ), to be progra mmed by the License e; and
(ii) One (1) Downstream Channel for Government Access Programming, to be programmed by the Town.
