Common use of Public Reporting Clause in Contracts

Public Reporting. The obligations in Sections 5.1(a) and (b) may be satisfied by furnishing, at the option of Holdings, the applicable financial statements as described above or an Annual Report on Form 10-K or Quarterly Report on Form 10-Q for Holdings for any Fiscal Year, as filed with the U.S. Securities and Exchange Commission.

Public Reporting. The obligations in Sections 5.1(a5.1(b) and (bc) in respect of Holdings’ financial statements may be satisfied by furnishing, at the option of Holdings, the applicable financial statements as described above or an Holdings’ Annual Report on Form 10-K or Holdings’ Quarterly Report on Form 10-Q for Holdings for any Fiscal YearQ, as filed with the U.S. Securities and Exchange Commission.SEC, as applicable;
