Common use of Purchase for Cancellation Clause in Contracts

Purchase for Cancellation. Subject to applicable law and to the provisions described in Section 5 above, the Corporation may at any time purchase for cancellation all or any number of the Series AM Preferred Shares outstanding from time to time at the lowest price or prices at which in the opinion of the board of directors of the Corporation such shares are obtainable in the open market (including purchases from or through an investment dealer or a firm holding membership on or that is a participant of a recognized stock exchange) or by tender available to all Holders or by private agreement or otherwise.
