Common use of Pursuant to the Voting Clause in Contracts

Pursuant to the Voting. and Exchange Trust Agreement (which be this reference is incorporated into the rights, privileges, restrictions and conditions attaching to the Exchangeable Shares as if set forth herein in its entirety) the holders of Exchangeable Shares (other than the Secure, its subsidiaries and Affiliates) shall be entitled to receive notice of and instruct the Trustee under the Voting and Exchange Trust Agreement to exercise voting rights at meetings of holders of Secure Common Shares, all as provided for in the Voting and Exchange Trust Agreement.
