Common use of Qualification of Trustees Clause in Contracts

Qualification of Trustees. Trustees shall meet the following requirements and complete the Trustee Attestation attached as Schedule "C":‌ (a) be an individual; (b) be a resident of Canada; (c) be at least eighteen years of age; (d) not be found under the Substitute Decisions Act, 1992 or under the Mental Health Act to be incapable of managing property, or been found to be incapable by a court in Canada or elsewhere; and (e) not be an undischarged bankrupt.
