Qualifications on entitlements and eligibility. An employee who is not an ‘eligible casual employee’ within the meaning of the Act, or one engaged on a seasonal basis, is NOT entitled to parental leave. 6.4.3.1 To be eligible for and entitled to parental leave, an employee must have served at least 12 months of continuous service with the employer immediately preceding: a) in the case of maternity leave, the expected date of birth; or otherwise b) the date on which the leave is due to commence. 6.4.3.2 The entitlement to parental leave is reduced in the case of: a) Maternity leave - by any period of extended paternity leave taken by the employee’s spouse and/or by any period of paid maternity leave or other paid leave (in accordance with the Act) or special maternity leave taken by the employee; b) Extended paternity leave - by any period of maternity leave taken by the employee’s spouse; c) Extended adoption leave - by any period of extended adoption leave taken by the employee’s spouse.
