Qualified Operator. Operator is qualified to obtain any Permits and Environmental Permits necessary for Operator to operate the Facilities as of the Turnover Date. Without limiting the foregoing, Operator is not aware of any reason or circumstance that would prevent Operator from procuring the Operator Required Regulatory Approvals.
