Common use of Qualifying Floating Charge Clause in Contracts

Qualifying Floating Charge. (a) The floating charge created by the Chargor pursuant to Clause 3.1 (Creation of Floating Charge) is a “qualifying floating charge” for the purposes of paragraph 14.2(a) of Schedule B1 to the Insolvency ▇▇▇ ▇▇▇▇. (b) Paragraph 14 of Schedule B1 to the Insolvency ▇▇▇ ▇▇▇▇ shall apply to this Deed and the Secured Party may appoint an Administrator to the Chargor pursuant to that paragraph.

Qualifying Floating Charge. (a) The floating charge created by the any Chargor pursuant to Clause 3.1 5.1 (Creation of Floating ChargeCreation) is a “qualifying floating charge” for the purposes of paragraph 14.2(a) of Schedule B1 to the Insolvency ▇▇▇ ▇▇▇▇. (b) Paragraph 14 of Schedule B1 to the Insolvency ▇▇▇ ▇▇▇▇ shall apply applies to this Deed Debenture and the Secured Party Security Agent may at any time after a Declared Default appoint an Administrator to the administrator of a Chargor pursuant to that paragraph.

(a) The floating charge Charge created by each of the Chargor Chargors pursuant to Clause 3.1 Clauses 5.1 (Creation of Floating ChargeGuarantor floating charge) and 5.2 (Issuer floating charge) above is a “"qualifying floating charge” " for the purposes of paragraph 14.2(a) of Schedule B1 to the Insolvency ▇▇▇ ▇▇▇▇Act. (b) Paragraph 14 of Schedule B1 to the Insolvency ▇▇▇ ▇▇▇▇ Act shall apply to this Deed and the Secured Party Security Trustee may appoint an Administrator to of either of the Chargor Chargors (as applicable) pursuant to that paragraph.

(b) Paragraph 14 of Schedule B1 to the Insolvency ▇▇▇ ▇▇▇▇ shall apply to this Deed Debenture and the Secured Party Administrative Agent may appoint an Administrator to the relevant Chargor pursuant to that paragraph.
