The Provider shall put in place and maintain in force the following insurances with the following minimum cover per claim. If this default position is not appropriate in relation to the nature and risks of an individual call –off contract, the Provider shall effect and maintain the different types and /or levels of insurance required by a Contracting Authority in respect of a call –off contract. Employer’s liability insurance £5M Public liability insurance £2M The level of cover may be increased by a Contracting Authority for individual call –off contracts when there are exceptional risks on the site of the works. All Risk Insurance £1M As this covers any possible damage to the contracts works, the level of cover may be adjusted by a Contracting Authority for individual call-off contracts. The level of cover should be for a minimum of the contract value plus all possible extras and inflation to contract completion. Professional indemnity insurance £1M As this covers design responsibility for design and build projects, the level of cover may be adjusted by a Contracting Authority for individual call-off contracts. The level of cover should be a minimum of twice the contract value of the work plus any exceptional risks and not less than £1m Promptly following the execution of this DPS Agreement, the Provider shall, if it has not already delivered an executed deed of guarantee to the Authority, deliver the executed deed of guarantee to the Authority as required by the procurement process followed by the Authority. Failure to comply with this Key Provision shall be an irremediable breach of this DPS Agreement.

Quality assurance standards. 2.7.1 It is essential that the supplier hold current accreditation with EFI or ASHI for Registry Typing and second field resolution HLA A, B, C, DRB1, DRB3, DRB4, DRB5 and DQB1 typing and maintain the accreditation throughout the term of the contract. 2.7.2 Data analysis must conform to an agreed version of the IMGT/HLA Database, the same database must be used for all analysis of HLA types in the first phase of testing 2011/12. 2.7.3 The contractor must complete and comply with the NHSBT information security questionnaire.

The Department will evaluate the Provider’s program, in accordance with section 985.632, Florida Statutes, to determine if the Provider is meeting minimum thresholds of performance pursuant to the Department’s quality assurance standards. 2. The Provider shall achieve and maintain at least an overall performance rating in the "minimal" range for applicable quality assurance standards. Failure to achieve at least an overall performance rating in the "minimal" range shall cause the Department to conduct a second quality assurance review, within six (6) months. Failure of the second quality assurance review shall cause the Department to terminate the Provider's contract, unless the Department determines there are documented significant extenuating circumstances. In addition, if the Provider’s Contract is terminated, the Department may not contract with the same Provider for the terminated service for a period of twelve (12) months. 3. Quality assurance reviews shall be based only on standards assessing compliance with this Contract, local, state, and federal laws, rules, regulations and codes, as well as Department policies, procedures and manuals that are in effect on the date that this Contract is fully executed, unless otherwise negotiated in writing between the Department and the Provider. 4. The Provider may ensure a minimum of one (1) staff member per Contract participates in an on-site quality assurance review in another judicial circuit on an annual (calendar year) basis. The Provider shall ensure all staff participating in quality assurance reviews are at the management or supervisory level, have a minimum of a Bachelor’s Degree unless a waiver request has been submitted and approved by the Department, and have completed the Department’s Quality Assurance Peer Reviewer Certification training program. Participation in the training and the review shall be at the Provider’s expense. 5. The results of quality assurance reviews and final scores do not relieve the Provider of its responsibility for compliance with the provisions in this Contract.
