Common use of Quality of Materials Clause in Contracts

Quality of Materials. The General Contractor shall furnish goods, products, materials, equipment and systems which: (i) comply with this Contract For Construction; (ii) conform to applicable specifications, descriptions, instructions, drawings, data and samples; (iii) are new (unless otherwise specified or permitted) and without apparent damage; (iv) are of quality, strength, durability, capacity or appearance equal to or higher than that required by the Construction Documents; (v) are merchantable; (vi) are free from defects; and (vii) are beyond and in addition to those required by manufacturers' or suppliers' specifications where such additional items are required by the Construction Documents.
