QUANTITIES SHIPPED. Weights and quantities shown hereon are estimated. Unless otherwise agreed to in writing, invoice weights may vary in accordance with permissible variations of +/- 10%. Unless specified elsewhere in the Agreement, ATI may make partial shipments and may invoice for each partial shipment separately. Partial shipments shall not relieve Buyer of its obligation to accept delivery of remaining shipments.
QUANTITIES SHIPPED. Any claim by the Buyer that Plasti-Fab failed to deliver the agreed-upon quantity of Goods must be submitted to Plasti-Fab in writing within five days after the Buyer receives the Goods. If the Buyer fails to do so, then it shall be conclusively presumed that the agreed-upon quantities of Goods were delivered.

  • Quantities The estimated quantities provided by the City are not guaranteed. These quantities are listed for informational purposes only. Quantities vary depending on the demands of the City. Any variations from the estimated quantities shall not entitle the bidder to an adjustment in the unit price or any additional compensation.

  • Drop Shipped Off loaded by carrier to an Agency loading dock or designated area. There will be no charge to the ordering Agency for this delivery method.

  • Shipment Dell will ship the APEX System to the Site when included as part of the APEX Service. The terms and process for shipment and delivery of the APEX System will be stated in the applicable Service Offering Description.

  • Shipments The Vendor shall ship, deliver or provide ordered products or services within a commercially reasonable time after the receipt of the order from the TIPS Member. If a delay in said delivery is anticipated, the Vendor shall notify TIPS Member as to why delivery is delayed and shall provide an estimated time for completion of the order. TIPS or the requesting entity may cancel the order if estimated delivery time is not acceptable or not as agreed by the parties.

  • Quantity If Seller delivers more than the quantity of Goods ordered, Buyer may reject all or any excess Goods. Any such rejected Goods shall be returned to Seller at Seller's risk and expense. If Buyer does not reject the Goods and instead accepts the delivery of Goods at the increased or reduced quantity, the Price for the Goods shall be adjusted on a pro-rata basis.
