The State of Texas desires to facilitate private sector investment and participation in the development of the State’s transportation system via public-private partnership agreements, and the Texas Legislature has enacted Transportation Code, Chapter 223, Subchapter E (the “Code”), and TxDOT has adopted Sections 27.1-27.9 of Title 43, Texas Administrative Code (the “Rules”), to accomplish that purpose.
