Common use of Railroads Clause in Contracts

Railroads. State or Agency shall follow State established policy and procedures when impacts occur on railroad property. The policy and procedures are available through the State’s Liaison, who will contact State’s Railroad Liaison on behalf of Agency. Only those costs allowable under Title 23 CFR part 140 subpart I, and Title 23 part 646 subpart B shall be included in the total Project costs; all other costs associated with railroad work will be at the sole expense of Agency, or others. Agency may request State, in writing and, at Project expense, to provide railroad coordination and negotiations through the State’s Utility & Railroad Liaison on behalf of Agency. However, State is under no obligation to agree to perform said duties.
