Common use of Re-export and Serious Shortage Clause in Contracts

Re-export and Serious Shortage. Where compliance with the provisions of Articles 7 and 9 leads to: (a) re-export towards a third country against which the State of the exporting Party maintains, for the product concerned, quantitative export restrictions, export duties or measures or charges having equivalent effect; or (b) a serious shortage, or threat thereof, of a product essential to the State of the exporting Party, and where the situations referred to above give rise or are likely to give rise to major difficulties for the State of the exporting Party, that Party may take appropriate measures under the conditions and in accordance with the procedure laid down in Article 31. The measures shall be non discriminatory and shall be eliminated when conditions no longer justify their maintenance.

Re-export and Serious Shortage. Where the compliance with the provisions of Articles 7 and 9 this Agreement leads to: (a) re-export towards a third country country, against which the State of the exporting Party maintains, maintains for the that product concerned, quantitative export restrictions, export duties duties, or measures or charges having equivalent effect; or (b) a serious shortage, or a threat thereof, of a product essential to the State of the exporting Party, and where the situations situation referred to above give gives rise or are is likely to give rise to major difficulties for the State of the exporting Party, that Party may take appropriate measures under the conditions and in accordance with the procedure laid down in Article 3126 of this Agreement. The measures shall be non non- discriminatory and shall be eliminated when conditions no longer justify their maintenance.

Where the compliance with the provisions of Articles 7 Article 5 and 9 leads of this Agreements related to: (a) re-export towards a third country country, against which the State of the exporting Contracting Party maintains, maintains for the product concerned, concerned quantitative export restrictions, export duties duties, or measures or charges having equivalent effect; or (b) a serious shortage, or a threat thereof, of a product essential to the State of the exporting Contracting Party, and where the situations situation referred to above give gives rise or are is likely to give rise to major difficulties for the State of the exporting Contracting Party, that Contracting Party may take appropriate measures under the conditions and in accordance with the procedure laid down in Article 3127 of this Agreement. The measures shall be non non-discriminatory and shall be eliminated when conditions no longer justify their maintenance.

Where compliance with the provisions of Articles 7 6 and 9 8 leads to: (a) re-export towards a third country against which the State of the exporting Party maintains, to this Agreement maintains for the product concerned, concerned quantitative export restrictions, export duties or measures or charges having equivalent effect; or (b) a serious shortage, or threat thereof, of a product essential to the State of the exporting Party, ; and where the situations referred to above give rise or are likely to give rise to major difficulties for the State of the exporting Party, that Party may take appropriate measures under the conditions and in accordance with the procedure procedures laid down in Article 3122 of this Agreement. The measures shall be non non- discriminatory and shall be eliminated when conditions no longer justify their maintenance.

Where compliance with the provisions of Articles 5 and 7 and 9 leads is related to: (a) re-export towards a third country against which the State of the exporting Contracting Party maintains, to this Agreement maintains for the product concerned, concerned quantitative export restrictions, export duties or measures or charges having equivalent effect; or (b) a serious shortage, or threat thereof, of a product essential to the State of the exporting Contracting Party, ; and where the situations referred to above give rise or are likely to give rise to major difficulties for the State of the exporting Contracting Party, that Contracting Party may take appropriate measures under the conditions and in accordance with the procedure procedures laid down in Article 3123 of this Agreement. The measures shall be non non-discriminatory and shall be eliminated when conditions no longer justify their maintenance.

The measures shall be non non- discriminatory and shall be eliminated when conditions no longer justify their maintenance.

Where compliance with the provisions of the Paragraph 2 and 3 of Article 12 and Articles 7 and 9 13 leads to: : (a) re-export towards a third country against which the State of the exporting Party maintains, to this Agreement maintains for the product concerned, concerned quantitative export restrictions, export duties or measures or charges having equivalent effect; or or (b) a serious shortage, or threat thereof, of a product essential to the State of the exporting Party, ; and where the situations referred to above give rise or are likely to give rise to major difficulties for the State of the exporting Party, that Party may take appropriate measures under the conditions and in accordance with the procedure procedures laid down in Article 3122 of this Agreement. The measures shall be non discriminatory nondiscriminatory and shall be eliminated when conditions no longer justify their maintenance.
